Reflecting on the recent changes in Panama’s government and their politics, as well as the ongoing crazy political battles that continue to battle on as they enter into the final lap of an election year, I wonder if they realize what this will mean for us in 2021? The recent decision made in Panama to add a Saturday to the “total quarantine”, didn’t appear as if it would do anything in theory to lower the rapidly increasing amount of total cases or daily deaths.

Friday afternoon, the government posted a decree that explained how Blocks 1 and 2 were not allowed to transit on Saturday even if they had a Salvoconducto. In all practicality, I can’t understand how they think they could possibly control that. The Salvoconducto document doesn’t give any indication to which Block you pertain to, it only gives you your safe passage to operate. That’s a complicated task for the police force to handle. How are they supposed to know which salvoconducto is still good and which isn’t? Sure, private security personnel should be allowed through, medical staff, but also Building management personnel and other common job positions as well. And knowing how everyone here is good at playing the “juegavivo”, I can only imagine how they play their way through a police checkpoint.

Cop at checkpoint: “Papers please!”

Guy who works at a Block 2 business hands him the salvoconducto.

On the flipside of that, we have a worse scenario, AKA Scenario 2.

Everyone else could easily skate by or easily get stopped without merit.

I’m writing this Saturday afternoon.  I had a chance to hang out with the boys and play a few games, watch some quality television, introduce them to comedy greats like Jeff Dunham who is a ventriloquist managing dummies like Peanut, Achmed the Dead Terrorist, Walter (who is the spitting image of Joe Biden).  

One of these two is running for president… the other is a dummy. You choose which is which.

We had several employees working today and I noted that no one had any problems. I also knew of other companies who were in somewhat of a grey area as to whether or not they could transit today. They work in maintenance so they could go out for emergency work, but also had scheduled maintenance to do. I asked them and they told me that they had no problems transiting or getting to work today. Some of the employees came from Chorrera and were able to get through the check points with ease.

With this new information, I decided to go out just to see what the roads looked like. It was like any other Saturday. Lot’s of cars in transit, but surprisingly, no security cones or police around to do random checks. It was actually the opposite of what I thought they were going to be doing. It makes me wonder if this additional quarantine day, maybe it’s truly meant for police to take a break from their constant work and stress during the week? It’s as if nothing had changed.

Quite frankly, the way I see this, we’re on our own. Those who are on full quarantine and doing what you can to maintain your distance from others, especially when you have to go out shopping for food, I commend you. There are so many who are doing absolutely nothing to avoid getting sick. It’s not easy to stay the course, but keep at it.

Later, there were further reports that the 7 missing were found dead in an old abandoned military bunker close by. There were signs of severe trauma and possibly bullet perforations in their bodies. Some reports claim that they had appeared to have been beaten, others have said that they were tortured and shot. Investigatively, there is a difference, but apart from that they way they died is irrelevant. It’s more than just sad what happened, it’s horrible, abominable. Whatever happened and who ever did it needs to be found. I’m sure the authorities will find the culprits as they’re good about these types of cases. No crime is perfect and we have at least 7 witnesses to start with.


BRETT’S TID BITS – COVID-19 EXPOSURE LOGGING

I have an iPhone. This is supposedly on Google Android phones as well. If you go to Settings, Privacy, Health you’ll come to a new addition which was uploaded in your last IOS update called “COVID-19 Exposure Logging”. It should be off, but there has been some concern and the conspiracy theorists came out with comments that it was uploaded without your permission, in a sneaky way and that’s not true.

Every time you upgrade your operating system, you get the option to not do it and you’re told what’s being added.  It was there, I assure you.  This is only operable if you want it to be.  And it doesn’t even work unless you have willingly downloaded an app that works together with this feature.  What it does is enables the user to determine if they’ve been in contact with someone else who has been detected with COVID-19.  

It works through a process of “contact tracing”.  If you have the app and the “Exposure Logging” is turn on, you’re allowing minimal random-ID information to be shared via Bluetooth.  You’re also pick up information from others who have also set up their phones for the same.  As stated in the product information, it cannot access any data in, or add any data to the Health app.  Why did they add this?  Because one of the first things you get asked after finding out that you have COVID-19 is “who have you been in contact with?” or “how did you get it?”.  The purpose of this is to see who you could have been in contact with so if THEY get sick, you will get a message from the phone of the person who was detected with the virus, informing you that may have come in contact and you may be exposed.  The other alternative is for that person to hopefully remember everyone they’ve been in contact with and to give that information to the medical personnel; but this is impossible.

Just the same, even though it’s on your phone, it doesn’t work unless you want it to. For the people who are concerned about your privacy, I can assure you that with all of the contraptions, services and things that you probably already do or own, such as computer, Fit Bit, Alexa, Cell phone, GPS, Residency Registration Information, phone bill, Pizza delivery contact information, etc etc, if Big Gov wants to know where you are or what you’re doing, “they” can find out. Your only option, if you’re worried about this new function on your phone, is to abandon technology altogether, find a nice shack in the hills of Santiago and grow your own self-sustaining farm, never to return to society.

The decision of the Ministry of Labor and Labor Development (Mitradel) to make some temporary changes to the Labor Code through a bill for the protection of employment, has been rejected by union organizations, economists and employers, who assure that it is not product of the consensus of the Tripartite Table, which requires a new revision.

The controversial proposed Mitradel law contemplates reducing the payment of the extraordinary day, the surcharge on public holidays or national mourning, the extension of the working day and sectioning the payment of the second and third installments of the thirteenth month, among other aspects.

Union organizations maintain that the Government’s initiative modifies the Labor Code and affects fundamental principles of workers’ rights.

The Executive Body presented through the Labor Minister Doris Zapata, the bill to the National Assembly that allows to extend the suspension of work contracts in companies until December and modifies the payment of the thirteenth month.

Eduardo Gil, secretary general of Union Convergence, explained that the Mitradel proposal is unfounded since the overtime surcharge seeks to compensate workers for working beyond their regular hours and now it is intended to limit this practice .

He stressed that according to the Labor Code, the employee who works in a company can only work 3 hours overtime three days a week, for a maximum of 9 hours a week; while the bill proposes that they can work 4 hours overtime four days a week, for a maximum of 16 hours a week.

In addition, the differentiation of the surcharge by the stage of the working day in which it is worked is eliminated, which was 25% in the day shift, 50% in the 50% mixed shift and 75 in the night shift, limiting the surcharge to only 25% .’

While, in the case of national holidays or mourning, which imply the payment of a surcharge of 150% plus the compensatory day, the bill reduces it to only 100%, so that workers would lose 50% of the surcharge. All of which, in Gil’s opinion, is unjustified.

Another aspect that affects workers is the form of payment for the second and third installments of the thirteenth month.

According to the Mitradel, workers who never stopped working will be paid according to the Cabinet Decree that created it. The payment will not be sectioned. The possibility of sectioning the payment, according to the proposal, would be for companies that have closed, suspended workers or modified their working hours.

The entity clarifies that the law would only be applicable to companies that reported affectation due to the pandemic, which generated the closure, suspension of contracts and modification of the working day.

“The companies that never closed, suspended or modified, will have to stick to what the labor law establishes, both in the 13th month, and in other work scenarios,” the entity said.

“We did not find any argument to justify these changes that reform the Labor Code and that negatively affect the income and living conditions of workers, and even when the Government says these are temporary measures that only affect a specific sector of the economy, it is dangerous for us to adopt measures that are harmful to the interests of workers and that lack economic and social foundations, even more so when we are the workers who are bearing the brunt of this crisis with thousands of people with contracts suspended from who have not been guaranteed the minimum means to subsist, “emphasized Gil.

For the business sector, although the announced changes are temporary, it includes elements that were not agreed upon in the Tripartite Table, which requires revision.

The president of the Chamber of Commerce and Industry of Panama, Jean-Pierre Leignadier said that they are in the process of detailed review of the bill.

“There are several elements with which we do not agree and I would not like to go into depth because they are much more legal than labor-related issues, so in due course we are going to give our opinion,” he said.

Currently, the Mitradel maintains more than 260,000 suspended contracts from some 17,000 companies nationwide. However, with the reopening of Blocks 1 and 2, more than 30 thousand jobs have been reactivated.

COVID-19 in Panama will impact employment in 7 sectors that together represent 941 thousand 583 jobs (509 thousand 891 formal and 431 thousand 692 informal), practically half of the Employed Population, and contributed 3 out of 5 new jobs generated in the last 5 years.

The economist Augusto García considers that this bill does not seek to protect the employment or safety of workers because now they will have to work longer hours and pays you less, “he said.

INSTRUCTIONS ON HOW TO PICKUP FAMILY MEMBERS AND FRIENDS FROM HUMANITARIAN FLIGHTS

The Foreign Ministry of Panama shared this Friday, July 17, important information for people who are going to pick up their relatives or friends from repatriation flights.

  • They stated that only one family member should go to the airport, carrying the plane ticket of the person who will arrive.
  • At the checkpoints they should say that they are going to the airport to pick up their relative.
  • Police officers will have a passenger list to verify the information.
  • They will not be able to enter the airport, they must remain in the parking lots.
  • Passengers will depart in groups of 20 people.
  • The process can take up to 3 hours.
  • On the return trip, they will be able to pass showing their passport with the entry stamp that shows that they have just arrived in the country.
