With the holiday season upon us, with its hands gently clutching our throats, trying so graciously to strangle the life out of all of us, I begin to recall again how ignorance is NOT bliss.  Oh sure, the process of ignorance, the very moment that one is ignorant, is about as blissful as you can get, but the long-term result is quite the opposite.  Coming from a small town, I have so many wonderful memories of how the innocence (not ignorance) of the townspeople really brought out the magic of Christmas.  The colder weather and snow added greatly to that effect, but along with those brisk winds and floating snowflakes came a warmth from the people with good cheer in full force.

At times, however, that innocence is easily manipulated either intentionally or not, and is easily transformed to ignorance.  I grew up in a predominantly protestant community, very specifically a Lutheran community.  It was so Lutheran, I was raised to believe that our religion was the worldwide frontrunner for religions.  I’m not sure if that’s innocence or ignorance, but at the time it was a blissful thought.  Then I started asking questions at Sunday school; forbidden questions, I suppose.  “What’s Hanukkah?”, I innocently asked one magically crisp, snowy morning.  “That’s a different religion.”, I was quickly shunned and our class moved along to the topic of Jesus’ birth, or something more Christmasy.  “Excuse me, what other religion?”, I was shy, but tenacious and apparently a bit unruly.  Because, just then, the lights dimmed and there was an uncomfortable warmth radiating from our beautiful Sunday School teacher’s forehead.  Her gaze towards me was something to never forget and I began to sweat as all of the snow within a mile radius of us melted away.  In one deep guttural breath, she said “We don’t talk about other religions here!” and I think I fainted, because I don’t remember anything after that.  As a matter of fact, any time Hanukkah was mentioned in common settings, I would quickly remember my Sunday school teacher as she shushed me, her eyes ablaze and index finger pressed firmly against her lips.

OK, maybe, perhaps, that was a bit of an exaggeration.  But fast forward 28 years later, and what isn’t an exaggeration was when my own daughter, at age 14, had the opportunity to go to my hometown school for a couple of months during the winter and was told by her history teacher that Panama had been invaded by Chinese Communists.  (Long sentence, breathe deep.)  She called me that day, extremely concerned.  She was genuinely worried that the teacher was angry with her because she told him he was wrong and that Panama did not get invaded by the Chinese military.  She was right, of course, but the teacher had some thought in his head that China invaded Panama once the US turned over the military bases to them.  And not even an actual Panamanian could coax him otherwise.  The teacher didn’t know of his own ignorance, but he was quick to teach it and that’s why I insist that ignorance is not bliss.  Ignorance is damaging.

Fast forward another 14 years more or less…  In today’s world, ignorance abounds and has caused quite a bit of strife and heartache to so many.  The magic I knew as a child isn’t gone.  I’d like to think that I’ve been able to duck and dash my way through the fields of ignorance mostly unscathed.    If anything, that magic has grown to appreciate, not only the beauty of my religion, but the magic and wonders of those “other religions” as well.  And to be clear, ignorance is just ignorance, but retaining a bit of the wonders and innocence of our youth feels to be much closer to bliss.

So, Chag Urim Sameach! to the good people in my life who are coming together to celebrate and give thanks during their Festival of Lights we know as Hanukkah.

It should be remembered that Law 157 of August 3 that allows the suspension of employment contracts has a deadline of December 31.

Minister Zapata said that all the sectors with whom they have met are aware “of the reality and need that we have to suspend or establish this extension or a new guideline to extend the suspension of contracts.”

According to the minister, “times define everything”, since in the end, to be able to make an analysis, “a company that opened 6 months ago is not the same as one that did it three”.

In conversations on the issue, some support the proposal, others do not, the minister acknowledged. “As a National Government we have tried to listen to all the actors to see their concerns and to articulate the proposal,” she said.

Zapata insisted that the proposal has already been raised and is being reviewed, gradually, what will be the restart of activities and the integration of workers by sector.

She added that an analysis has been made by economic activity, since there are sectors that need “special treatment”, as is the case of the tourism sector and derived activities. In fact, recently the National Chamber of Tourism of Panama asked the Government to consider, as a top priority, extending the period of the suspended contracts to six months from January 2021.

Other sectors that would receive special treatment, since they have not yet been able to reopen their activities, are the areas of education, bars, entertainment, employers, which represent – according to the minister – 15,400 suspended contracts. Similarly, small and medium-sized companies have also been considered in this segment.

As a result of the pandemic and the consequent paralysis that the economy has suffered, in Panama a temporary suspension of the effects of employment contracts was adopted, in accordance with the provisions of the Labor Code, for one month and four extensions. Subsequently, and with a crisis that led to having 282 thousand people with suspended contracts, Law No. 157 of August 3, 2020 was issued. This regulation allowed the extension of the suspension of employment contracts until December 31 2020.

SPECIALISTS WARN THE RISKS OF FALSE NEGATIVES FROM COVID-19

Given the suspicion of having been infected with COVID-19, even with a negative test result, specialists recommend carrying out a preventive quarantine.

Although it may seem strange, a person can be positive for covid-19 and in an initial test come out negative.

Doctor Augusto Hernández, an intensivist physician, explained that there is a significant rate of non-detection of covid patients even with the best tests in the world. That is why it is recommended that close contact of a patient at risk, has to keep the quarantine.

Jean Paul Carrera also an epidemiologist from the Gorgas Memorial Institute added that the incubation period of the virus in people can be up to 14 days. When is the best time to get tested? Sandra López recommends counting four days after contact with the positive, to increase the probability of detecting the virus.

So far, virus mutations do not appear to influence laboratory results. This was explained by the microbiologist Silvio Vega.

“If it mutates in specific regions of nucleic acid we would have a chance of losing it, but generally those small mutations can still be detected in PCR.

And if it mutates in the production of the antigen, then we could lose it, but what is known so far is that this virus like all viruses can mutate, but that does not significantly alter its structure, he pointed out.

AGUADULCE MUNICIPALITY ESTABLISHES ‘DRY LAW’ UNTIL DECEMBER 21

MIVIOT WILL ALLOW EVICTIONS TO PEOPLE WHO CAN IN FACT PAY RENT

LAW IS PREPARED TO AVOID BUSINESS BANKRUPTCY

It is expected that a large number of companies will not be able to meet their obligations to the State, banks, finance companies and suppliers, which would make the economic recovery process that the country expects more difficult.

The dire projection that indicates that 40% of companies could go bankrupt as a result of the pandemic has prompted the drafting of what would be an insolvency bill, of temporary application, discussed between the National Center for Competitiveness (CNC), the private sector and the Government.

The document, which would be presented by the Ministry of Commerce and Industries (MICI) before the National Assembly, would establish conditions so that debtors and creditors can reach an agreement, through a regulated extrajudicial process that is adapted to the current circumstances imposed by the Covid-19.

The bill is aimed at refloating the company that faces a situation of illiquidity, so that it can operate and determine if a reorganization plan established in conjunction with its creditors is viable, in a waiting period of protection, explained Irvin Halman, president of the CNC.

The project would give the creditors certainty of a maximum term of six months to determine the viability of a reorganization, extending this term only by agreement of the majority of the creditors.

The bill, presented by the CNC to the Executive Branch through the Mici, contemplates the modality of arbitration centers that allow intervention exclusively for the reorganization stage of the company, avoiding congestion and collapse in the judicial system.

The pandemic threatens the subsistence of more than 40 thousand companies in the country. Confinement and slow economic recovery tick off many companies that are unable to honor their payments starting next year.

As a result of this diagnosis, the private sector, specialists in the financial market, lawyers and the Government itself have structured a legal solution to face the looming problem. The ultimate goal would be to avoid massive bankruptcies due to non-payment of debts.

The idea is to present to the National Assembly, through the Ministry of Commerce and Industries (Mici), a bill of “reconciled reorganization”.

Panama has Law 12 of 2016, effective as of January 2017, which establishes mechanisms for the protection of credit, within a reorganization and, finally, to reach the point or condition of permanent illiquidity in the insolvency process, the attention of the credits.

But the lack of budgetary resources has determined that the specialized courts created by Law 12 of 2016 have not been established.

This, as said Irvin Halman, president of the National Competitiveness Center (CNC), is aggravated by the current situation caused by Covid-19, since many companies have been immersed in a situation of force majeure, not provided for in Law 12 of 2016.

“The projections indicate that a large number of companies can reach total insolvency and liquidation if they do not have a legal mechanism that allows them to attend timely and effective reorganization processes,” he explained.

In the current context, companies are limited or prevented from activating, not necessarily because of a controversy with their creditors, but because of the stoppage of operations in which they have assets and obligations, indicated the president of the CNC, an organization without the purpose of profit, in which the public and private sectors participate.

Therefore, special mechanisms are required, fast and flexible enough to respond to the situation of economic abnormality.

It is estimated that, at the end of this year, the country would be mired in a labor crisis, precisely because of the weak situation of the business fabric. The estimate is that some 500,000 people would be unemployed, as a result of the ravages of the pandemic.

Halman told this newspaper that a necessary condition to save jobs and companies is to provide alternatives to debtors and creditors, through a regulated extrajudicial process.

According to what will be proposed in the bill, companies and creditors may go to a recognized conciliation center, such as the Chamber of Commerce or the Panamanian Chamber of Construction, where they will undergo the reorganization process.

The companies would have a period of up to six months to demonstrate the viability of the reorganization.

Halman specified that the bill gives certainty to the creditors of this term to determine the viability of a reorganization, but this period can be extended by agreement of the majority of the creditors.

During this time, the companies will have the opportunity to oxygenate themselves and solve their illiquidity problem, with which they will be able to determine if the reorganization plan established in conjunction with their creditors is viable.

The reconciled reorganization process proposed by the bill begins with the presentation of the request for the reorganization process before the insolvency judge or, failing that, the civil circuit judge without need of documents indicated in Law 12 of May 19, 2016, and the presentation of a notice of intention.

When the reorganization plan is agreed upon through the reconciled reorganization process, it will be sent to the judge in the case for confirmation and implementation of the approved plan.

In the event that a reorganization plan agreement is not reached, the conciliation center will issue a certification so that the judge can proceed to close the file.

In this case, the rights of creditors to exercise them individually, or through the beginning of a liquidation process, will be immediately restored.

The law will be of temporary application. Its execution time will be known once the document is presented in the National Assembly.

HOSPITAL IN WEST PANAMA ENTERS FINAL PHASE

The construction of the field hospital in Panama Oeste entered its final phase and the health authorities hope that it will soon begin to function. Panama Oeste is the second province with the most cases of COVID-19.

The structure is located at the back of the Santiago Barraza Polyclinic, in the La Chorrera district.

In the same 40 beds were enabled for respiratory care. Personnel in charge said it took 10 days to lift it.

Alex González, the general director of Health Services and Benefits, said that in recent days the health authorities have appointed about 100 doctors. He urged health professionals who are not working to take their documents to the human resources office of the Social Security Fund to be hired.

“If there are doctors who are at home and do not have a job, go to the offices and they will be hired at once,” he said.

This, given the increases in COVID-19 cases that have been registered in recent days, coupled with the fatigue of the medical personnel who have been working since the beginning of the pandemic, many of them, without rest.

FROM INMATES TO THE BLIND: VERNON, 19 YEARS OF HELPING OTHERS ABROAD

Vernon.

It was a rather unfortunate turn of events that pushed Vernon and his wife, both American citizens, to move to Belize in 2001. But it was never a decision that they regretted. In fact, the couple put their time, knowledge and resources into helping others build a better life for themselves. First with inmates at the Belize Central prison and today with blind, unemployed young people in Panama. Here is his story.

Tell us a little bit about yourself

I am originally from the Tidewater area of Virginia and currently live on the outskirts of Panama City, Panama in Cuidad de Saber and in Fairfax, Virginia, USA.  I began my career in the art of jewelry fifty years ago when I started coin piercing and making simple earrings, necklaces and bracelets.  My interest grew as I read and studied every book on jewelry design, hand fabrication and metal smithing that I could find in the local library.  My life’s work has revolved around jewelry design and the production of wearable pieces of art.  I have been privileged to win numerous national and international awards, twice receiving recognition from the International Pearl Design Competition in Tokyo, Japan.  In addition, I have been privileged to teach jewelry design and the art of goldsmithing to over thirty apprentices, 140 inmates in the Belize Central prison, numerous students in vocational training schools and universities and many aspiring designers.

You first moved abroad in 2001. What prompted this move? Why not volunteer in your home country?

My wife and I moved to Belize in 2001.  The move followed a car accident I was involved in several years before.  The accident left me in considerable physical and mental pain and rendered me incapable of productive work.  Finally I found a doctor who correctly identified the cause of my incapacitating pain and a surgery restored me to good health.  For almost four years I had sat in my chair, in pain, staring out the window.  Once I recovered, I knew I wanted to dedicate the rest of my life to helping others.  I decided that I wanted to teach and share all I had learned.  And, I wanted to donate my considerable inventory of tools and equipment to a university in the USA.  I was surprised to learn that I had too much for any one school to take.  I was then fortunate to find a project in Belize (the Center for Employment Training) which happily accepted my donation and invited me to teach.

How did you decide to move to Belize?

Actually, Belize was not my first choice.  I had originally planned to start a jewelry training school in St. Thomas, USVI.  But, that fell through at the last minute after I had sold my homes in the USA, packed my belongings and was ready to move.  My wife and I had been planning the school in St. Thomas under the auspices of the US Episcopal Church in conjunction with the Diocese of the Virgin Islands.  When I contacted the National Church Office and explained what had happened,  they suggested I contact the bishop in Belize. I contacted Bishop Romero, he was thrilled with the idea, invited us to come and we left for Belize a week after we had planned to go to St.Thomas.

How was that experience for you?

Our twelve year experience living in Belize was awesome and overwhelming and joyful and heartbreaking – filled with incredible accomplishments and more than a few setbacks.  Adjusting to the culture was quite challenging.  On the surface, Belize appeared very ‘American’ – almost everyone spoke English and as a former British colony (British Honduras) things seemed very familiar.  But we quickly discovered, cultural differences were profound.  Although people were friendly they kept their distance.  We later realized that there was a deep mistrust of foreigners, especially folks from the US.  Many Belizeans  had endured years of what they felt was exploitation so most were skeptical of our intentions.  It took several years of hard work and allowing people the opportunity to know us before we were accepted. I learned a very important life lesson in Belize summed up in this saying: “Blessed are the flexible, for they shall not be bent out of shape.”

What were the most difficult things about life in Belize?

The most difficult things about living in Belize were the lack of infrastructure, widespread corruption and the political process in general. Belize was only 20 years old when we arrived having gained its independence in 1981.  It was a struggling young nation trying to get its feet firmly on the ground with all the ensuing problems that process entailed.

What was your favorite thing about Belize?

My favorite things about Belize were the people and the opportunities that were available once people trusted me. I was able to teach for several years in the vocational school.  Then I had the chance to build and equip a jewelry design and repair facility in the National prison which provided over 140 men with marketable skills. This program had the highest success rate of any program at the prison.  And then in 2006, my wife and I were able to spearhead the building of a state of the art primary school in the middle of a swamp, literally no dry land when we began construction. The school, Holy Cross Anglican, was built under the auspices of the Ministry of Education and the Anglican Diocese of Belize with the help of hundreds of volunteers from the US and Canada. Currently the school educates almost 500 disadvantaged children every year.  I could never have done these things in the USA. Belize was open and receptive to the dreams this crazy Gringo had and for this, I will be forever grateful.

How did you decide to move to Panama?

After living in Belize for twelve years and spending seven years building and overseeing the primary school, my wife and I felt it was time for the school to stand on its own two feet.  We wanted the school to truly be a Belizean undertaking and realize that would not happen as long as we were there. So we started considering where our next adventure might be. At that time, I heard from a fellow artist I had known in Virginia.  He was originally from Panama and was being honored by the Government for his outstanding contributions to the arts. He invited me to attend the ceremony and spend some time in Panama. My wife and I quickly realized that Panama was a beautiful country with much to offer. And through my friend, I met several folks in the Government and others involved in education all of whom encouraged me to move to Panama and share my knowledge.

How did you decide to open your jeweler’s school in Panama?

We moved to Panama in 2013 and took a long overdue vacation. But after a year of relaxing and traveling around, I was ready to get back to work. I had missed working with precious metals, gem stones and designing jewelry. And, more than creating beautiful pieces, I wanted to teach and pass along my knowledge. Initially I set up a small workshop in my home but quickly outgrew the space. A good friend approached me with an idea he had to open MakerSpace Panama and I quickly said, ‘Yes!’  My dream jewelers’ school and workshop began to take shape.

How important is this activity to you?

My jewelry school and workshop is incredibly important to me.  At the age of 72, I have a real reason to keep pushing myself and the incredible opportunity for new adventures like teaching the blind how to make jewelry and, being able to donate the tools and equipment for a jewelry school at the University of Panama and, volunteering to train the professors who teach the students there. Opening my state of the art private jewelry school and manufacturing facility allows me to teach professionals and amateurs as well as to create jobs for locals. I am merely a volunteer at my jewelry school happily enabling local men and women to earn a living through my efforts.

What does expatriation mean to you?

Expatriation is defined as the departure from the nation of one’s birth for permanent or prolonged residence in another nation.  My departure from the United States twenty years ago and my decision to live those years in Belize and now Panama has enlarged, expanded and incredibly enriched my view of the world.  My understanding and appreciation of the diversity of peoples and cultures has allowed me to be a citizen of the world not just a resident of a city in Virginia.  

You have volunteered and helped out during your whole life abroad. Looking back on these 19 years, what is the one lesson you will keep with you and what is your favorite memory?

The most important lesson I have learned over these past 20 years is that the impossible is not always impossible.

My favorite memory of Belize, and there are many,  but this one stands out.  My memory is Lester who was, in 2006, a young, illegal alien in Belize starting elementary school at Holy Cross. I watched him grow and flourish and graduate and attend high school and get his Belizean citizenship. I celebrated with him as he entered Medical school and we reminisced about his childhood growing up in a one room shack in the swamp adjacent to the school I started.  His memory warms my heart and makes all the blood, sweat and tears absolutely worthwhile.

Aaaaaaaand more wood projects.  For Mother’s Day, Queen Sayira humbly requested that I make a weight rack for her.  And by humbly request, I mean demanded that I enter into slavery during the morning of this glorious and beautiful event honoring mothers everywhere.  Oh, but not until after I make breakfast, wash the dishes, clean the house and give her a massage.  

How did I agree to this?  

Of course, building a weight rack out of wood can only be done if you have wood, enjoy molding wood to your very desires and have the equipment to do it.  Luckily, I’m that guy!  There was also a bit of selfishness in this task as I was sick of tripping over the Queen’s 50lb dumbbells all the time.

So here it is, the creatively named “Mommy‘s weight rack” in all its glory!:::  (Next time, she says, she wants me to add a wine dispensary for her cool downs.)
