This week has been full of ups and downs for me. Monday, was a good day, filled with a generous heap of accomplishments. Yesterday, however, I was continuously on the verge of ripping someone’s head off; anyone. Today, I’m back to worshipping flowers, voicing words of encouragement and fomenting happy thoughts. A good day for me isn’t necessarily the same definition of a good day for anyone else. And sometimes, a good day for me, means a very bad day for others. I quite literally started the week by ensuring that someone to lost their job. That may sound evil, but this same someone had been embezzling money from the company they worked at during the last 5 years it appears. Panama has a serious problem with its labor laws. It’s nearly impossible to fire someone unless they’re repeat offenders and sometimes even when you’ve caught them stealing, sleeping on the job, running off with the messenger for a romantic encounter, or anything else that would get them tossed to the road in a heartbeat back home in the good ol’ US of A.
We had this one case where the employee showed up for work, relieved his colleague from their post and when their colleague left, he immediately proceeded to return to his car, enter it and didn’t come out for 4 hours leaving his post abandoned. When we asked him what he did, he was to the point saying that he went to sleep, adding that he couldn’t sleep during the day for whatever excuse that I wasn’t interested in listening to. So, we initiated the process to fire him which involves payroll to calculate his final salary, Human Resources to analyze the information from the videos, hand-written statement from the subject admitting he was sleeping in his car, witness statements, etc. and little ol’ us to break the news to him and prepare ourselves in the event he was to morph into a disgruntled US postal worker. But now, the guy denies he did anything wrong stating, “I never said I was sleeping. I was providing covert security from the safety of my own vehicle.” Truth be told, we couldn’t see him sleeping, but that’s irrelevant. He wasn’t on his post and that should be enough, right? Well, not according to Panama’s Ministry of Labor. After a long battle, the guy won his case and was reinstated to his post. Lucky for us, but unfortunate for him, he had a family emergency and had to resign to help with the family farm, but if not, we would have been stuck with a very bad and vindictive employee for quite some time until HR could renegotiate his exit “amicably”.
So, what’s the moral to this story? Oh hell, I don’t know. I wish I had a simple solution. Really truly in the end, it’s all about overpaying them to leave and never come back. Stick to Mutual Agreements and avoid the “Despido” (Firing) process if at all humanly possible. At least with the mutual agreement, they can’t come back to contest it, after having already signed and agreed to the terms. Firing someone whether you think it’s justified is irrelevant. If the subject takes the case to the Ministry of Labor, it will only be their opinion that counts after the smoke clears.
Now, you can imagine the problems construction companies have when their employees are out protesting instead of building the roads and structures. They all have a right to protest even if that means the project is at a standstill. And, they can protest about ANYTHING even when it’s not related to their rights as an employee with the company that they’re working for. Here they are today, out on the street, protesting the high cost of living, all the while your house is no longer being built and your new shopping mall sits dormant looking all sad and hopeless with it’s rough cement spackle and non-existent roof. It sucks. But you know what doesn’t suck? Today’s article. Lol Enjoy!

PHARMACY OWNERS REITERATE THREAT NOT TO OPEN ON MONDAY
National Council of Private Enterprise
The National Union of Pharmacy Owners joined with the National Council of Private Enterprise (Conep) to analyze the Executive Decree that establishes a 30% reduction in the cost of 170 medicines.
Orlando Pérez, president of this guild warned that affiliated pharmacies will not open on Monday if the decree is maintained.
It was learned that this afternoon the Ministry of Health will meet with the unions to address the issue and a press conference will probably be held.
The business associations have demanded to participate in the negotiations and decision-making in the different tables that are established in the country.

THE LIST OF THE 11 CANDIDATES FOR THE CRIMINAL CHAMBER, WHAT QUESTIONS HAVE BEEN MADE?
The cards are on the table. The President of the Republic, Laurentino Cortizo already has the names of the 11 candidates for magistrate of the Second Criminal Chamber of the Supreme Court of Justice and their alternate.
A few days after receiving the list by the special evaluation commission of the State Pact for Justice, some questions have already come to light. This is because some of them have held positions in the Government or remain in office. Such is the case of the current administrator of the National Authority of Public Services (ASEP) Armando Fuentes.
For the former deputy and lawyer Ana Matilde Gómez, Fuentes does not meet the requirement, since he remains in the institution.
“He would not meet that requirement of being exempt from having occupied or being occupying a command and jurisdiction that prevents him from being appointed to the CSJ”
According to the jurist, this would generate a lot of suspicion, because Fuentes is within the current governmental gear.
Another official of this administration who is on the list of 11 candidates is Waleska Hormechea, current Attorney General of Accounts.

He currently holds the position of general administrator of the National Authority of Public Services.
Benito Vega González:
Lawyer with a master’s degree in procedural law; law and dispute resolution; registration and notarial law. He has a specialization in higher education. He is currently pursuing a master’s degree in criminal law and criminal procedural law. He has been teaching for 15 years. During his career he has held positions in the Attorney General’s Office and in the Public Registry. Currently, he is a public defender at the Institute of Public Defenders of the Judicial Branch.
Cristina Ciniglio De Vincenti:
Lawyer with a master’s degree in Maritime Law and Procedural Law. It is specialized in Higher Education and International Maritime Law. He has 30 years of experience working in various areas and periods in the Judicial Branch. She currently has eight years of holding the position of judge of the Maritime Court.

According to Jorge Giannareas, UNICEF social policy specialist in Panama, the supplies seek to guarantee high standards of health to children; since, they have the right to develop their potential from early childhood.
It should be noted that UNICEF is a United Nations agency that advises Governments and civil society organizations on children’s rights.

SUPREME COURT: RULING THAT MAINTAINED CRIMINAL JURISDICTION TO MARTINELLI IS UNCONSTITUTIONAL
On the afternoon of Thursday, August 11, the Judicial Branch reported that in the session of the Plenary of the Supreme Court of Justice it was agreed by majority to declare unconstitutional the decision of the Electoral Tribunal (TE) that maintained the criminal jurisdiction of former President Ricardo Martinelli (2009 – 2014) for the New Business case.
“The decision of the highest constitutional court, which was adopted by a majority, had as rapporteur the magistrate María Eugenia López Arias and had six votes in favor and three votes against,” the official communication highlights.
The magistrates who voted against and saved their vote, because they did not agree with the decision were: José Ayú Prado, Cecilio Cedalisse and Ángela Russo.
This ruling has its origin in a decision taken by the Plenary of the Electoral Tribunal to revoke the decision of the Second Electoral Administrative Court that at the time took away the electoral criminal jurisdiction of former President Martinelli.
The third judge liquidator of criminal cases, Baloisa Marquínes who is carrying out the New Business case, had requested the lifting of the electoral jurisdiction of the former president.
On February 23, 2022, an electoral court ruled in favor of Judge Marquínez and ordered the lifting of the jurisdiction, however, the defense of the former president immediately filed an appeal for which the case passed into the hands of the Plenary of the Electoral Tribunal that is made up of the magistrates: Heriberto Araúz, Eduardo Valdés Escoffery and Alfredo Juncá.
Magistrates Araúz and Juncá voted in favor of revoking the resolution that removed the electoral criminal jurisdiction of former President Martinelli, while Judge Escoffery made a vote saver.
“It is not feasible to require the judicial authority requesting the lifting of the jurisdiction to attach to its request the evidence that shows that the principle of specialty does not apply to Mr. Ricardo Martinelli, as does the majority ruling, since Article 313 of the Electoral Code provides that only the evidence that supports the request must be attached, that is, those related to the basis of the criminal case that follows the defendant,” Escoffery said in his vote saver.

ARAP FILES COMPLAINTS WITH THE PUBLIC PROSECUTOR’S OFFICE FOR THREATS TO SEVERAL OFFICIALS
The entity has filed the corresponding complaints with the Public Prosecutor’s Office
In compliance with its obligation to manage fisheries and prevent illegal fishing, the Panama Aquatic Resources Authority (ARAP) reported that it is applying the sanctions that the Law allows.
According to the ARAP, this policy of zero tolerance for illegal fishing has resulted in “threats” to the physical integrity of several of its officials.
“We warn that we know where these threats come from, which we do not take lightly, so we have put the corresponding complaints in the Public Ministry,” the ARAP stressed.
Similarly, this entity indicated that “we are cooperating with the authorities so that the respective investigations are carried out, in such a way that those responsible are punished in accordance with what is established by national laws.”
The ARAP statement concludes, noting that “we will continue to do our job, and we will not stop despite these threats.“
On the other hand, recently with the participation of residents and authorities of the province of Veraguas, out last Thursday the repopulation was carried out of 25 thousand tilapias in the Lake of the Forest Reserve La Yeguada in the district of Calobre.
The activity was carried out under the supervision of the ARAP, through the Directorate of Research and Development and with the approval of the Ministry of Environment (MiAmbiente).
Lake La Yeguada had twelve years without being repopulated and there the technical team and biologists of the ARAP, led by the deputy administrator Hamed Tuñón and with the presence of the regional director of the institution, Even Castillo, the biologist and zoologist Jorge Abadía, together with the locals, proceeded to contribute to the repopulation of the tilapia fry.
In this regard, Tuñón said that the important thing is that in this Government all the issues of aquaculture are being taken up and mainly the repopulation in the lakes in the country, since it is a cheap source of protein for farmers.
He also maintained that the ARAP is the only entity in the country, whose main objective is to repopulate with fry and other species, all sources of inland waters throughout the country, so that the various communities get the best out of it.

U.S. AND PANAMA RESUME SEARCH FOR TWO U.S. SERVICEMEN WHO DISAPPEARED IN 1985
The search mission resumed on August 8 in Santa Fe National Park
The U.S. Department of Defense, in conjunction with Panama’s Naval Air Service, the Ministry of Foreign Affairs and the Ministry of the Environment, resumed the mission to search for the remains of two members of the U.S. Navy, who disappeared on a training flight in 1985.
The U.S. Embassy in Panama said the mission began Aug. 8 in Santa Fe National Park and is expected to run through mid-December. This is the third rescue mission to be carried out in Santa Fe National Park, after the 2020 and 2021 missions.
On the U.S. side, this rescue operation is led by the International Agency for the Search and Recovery of Missing Persons (DPAA), on behalf of the U.S. Navy.
The DPAA’s mission is to provide the fullest possible accountability to the families and the U.S. of missing personnel on duty, the U.S. Embassy said.
The plane crash occurred in April 1985 in Panama, when the U.S. Navy aircraft did not return to the carrier after a training mission. At that time, a search and rescue mission was carried out with the collaboration of Panama, but it was not possible to locate the place of the accident. In 2019, youth from the area located the wreckage of the aircraft within Santa Fe National Park, and the DPAA began the investigation in January 2020.

GROUPS CALL FOR THE CREATION OF A COMMISSION TO MONITOR AGREEMENTS OF THE BASIC BASKET
The groups sitting at the single dialogue table, which is taking place in Penonomé, have asked the National Government to form a commission to monitor the agreements reached on the issue of basic food basket .
During Thursday’s session, the groups denounced that some businesses are not complying with the price of regulated products in the basic food basket.
They also indicated that several fishermen have not been able to obtain the subsidized fuel.
Deputy Labor Minister Roger Tejada said he asked the groups to offer information that would allow corrections to be made so that the prices of 72 regulated products are met.
Regarding the issue currently being debated, the situation of the Social Security Fund (CSS), Tejada said that the entity’s board of directors has been asked to incorporate the groups into the dialogue.
Tejada recalled that a report from the International Labor Organization (ILO) is awaited.
However, there was no further progress on the issue of SSC, since the session addressed the issues related to the follow-up of the agreements reached in the first four items of the agenda.
The single dialogue table resumed on Thursday after almost a week of recess.

APPROVAL OF CREATION OF BOARD OF TRUSTEES FOR ISLA IGUANA
Isla Iguana was declared a protected area in 1981 and attracts scientists, biologists and tourists
In the third debate, Law 174 was approved, which creates the Patronato Refugio de Vida Silvestre Isla Iguana, in the district of Pedasí, in the province of Los Santos.
Isla Iguana is part of the wildlife refuge of the same name and, near it, on the coast, is the Pablo Arturo Barrios Wildlife Refuge.
According to the reasoned legislation of Deputy Eric Broce, it will be a public and social order entity, non-profit, with its own assets, legal personality and autonomy in its administrative, economic, financial and functional regime.
The board of trustees will be composed of the Ministry of Environment, the mayor of Pedasí, a representative of the AMP, the ATP, the Association of Fishermen of Pedasí, an environmental NGO, a foundation with experience in research, among others.
The island was declared a protected area in 1981 and attracts scientists, biologists and tourists. It is home to about 5000 frigate birds. Frequently, there is the permanent or migratory presence of cetaceans such as the humpback whale, although dolphins are also frequent, among them, the Pacific spotted dolphin (Stenella attenuata) and the bottlenose dolphin (Tursiops truncatus).

LEPROSY CASES REPORTED IN GUALACA AND BARÚ DISTRICT
Two cases of adult leprosy have been reported to date in the province of Chiriqui in the first eight months of this year, a source from the Ministry of Health confirmed.
The two cases were treated by dermatology specialists at the Rafael Hernández hospital, where they were held for medical treatment.
The source confirmed that one case comes from the district of Gualaca and the second case was registered in the district of Barú.
Both cases were detected through a series of medical examinations.
Throughout the country there is an increase in cases, since last year only two events were reported and this time there are six cases, which worries health authorities.
The disease is caused by Hansen’s bacillus or Mycobacterium and for this disease the patient requires treatment, because the disease is transmitted through the respiratory tract and the person is infected when he remains in contact with an infected person for more than six months.
The disease affects the skin, peripheral nerves and organs of the body, the source confirmed.
Since 2018, Panama has been implementing a strategic plan of the World Health Organization (WHO) to eradicate the disease, which includes training for health personnel and medical review of patients diagnosed with leprosy.

KNOW THE 10 VACCINES THAT ARE BEING APPLIED IN THE COUNTRY
The Ministry of Health (Minsa) disseminated to the population the list of the 10 vaccines that are being applied in the inoculation days that are carried out both in the Rubí room of El Hotel El Panama, from Monday to Saturday from 7:00 a.m. to 3:00 p.m. and in other parts of the country.

Vielka Pérez, nurse in charge of the Minsa at this point of immunization told the population that vaccines are one of the effective prevention measures to combat diseases.
He explained that at the national level there are several points enabled for these days whose objective is to strengthen the complete vaccination scheme in children, youth, adults and older adults.
Pérez, stressed that the doses against Covid-19 of Pfizer pediatric and the third of reinforcement are being applied; also for adults covid-19 vaccines from the first dose to the fourth dose; that is, the second reinforcement.
He pointed out that vaccines to combat these diseases are also placed in Health Centers as well as in the points enabled free of charge.

NEW RULES FOR TOURIST TRANSPORT APPROVED IN THIRD DEBATE
Law aims to establish an orderly transport system
Bill 684, which establishes the regulatory framework for tourism transport, was approved again in the third debate by the plenary session of the National Assembly.
The proposal of Deputy Víctor Castillero had returned to the Legislative Branch after being partially objected to by the president.
This initiative establishes that the Transit and Land Transport Authority (ATTT) will work together with the Tourism Authority of Panama to ensure compliance with the new regulations.
A controlled maximum fare system will be imposed from Tocumen International Airport to the city centre.
Likewise, to safeguard the safety of passengers, public transport vehicles or taxis must maintain an insurance policy with full coverage of accidents and civil liability.
The amounts of these range from 10 thousand to 50 thousand dollars, depending on the type.
Those who fail to comply with these regulations will be sanctioned by the ATTT with the suspension of the operation certificate.
Other causes of this penalty are the suspension of the service, without justified cause; misuse of exemptions and subsidies established by law; and the non-payment of road taxes for two consecutive years.
Five articles of the law (6, 7, 9, 12 and 17) were initially vetoed in May 2022 due to inconveniences.
According to the Legislative Body, the sanction of this project would raise the quality of the service offer to visitors and reinforces the image of the country in terms of tourism.

CLAIMS TO INSURERS FOR COVID AMOUNT TO $138 MILLION
The Panamanian Association of Insurers (Apadea) revealed a report with figures for the first quarter of 2022, on insurance premiums subscribed that has increased by 7.7% compared to the previous year.
Health and auto insurance have been the ones that have increased the most during the last quarter.
The Association states that this responds to this economic reactivation. However, there is another important figure to mention, the claims for Covid, whose figure leads to an accumulated as of June 30, 2022, of 138.4 million dollars.
Carlos Tribaldos, president of the Association of Insurers of Panama, said that this figure has been decreasing.
They hope to be able to hold a congress in the coming weeks in which compliance issues will be discussed in terms of the insurance market, taking into account that the country is still in the fight to get out of the gray lists.

PROMULGATION IN OFFICIAL GAZETTE DISCOUNT OF 30% TO 170 DRUGS FROM THE EMERGENCY LIST
They will apply the 30% discount of medicines for six months
This Wednesday, Executive Decree No. 17 of Wednesday, August 10, 2022, was promulgated in the Official Gazette, which reduces by 30% the price of medicines established for consumers.
The discount on the price of 107 medicines will begin to take effect on August 15, 2022 for six months extendable, says the document signed by the President of the Republic, Laurentino Cortizo.
For the application of the discount, the price established on June 30, 2022 will be taken as a basis and seeks to guarantee medicines at cheaper prices for all Panamanians.
The measure will not apply to medicines manufactured by the national industry and to those generic medicines whose price is equal to or below 60% of the price of the reference medicine as of June 30, 2022.
It will be up to the Consumer Protection and Defense of Competition Authority (Acodeco) to verify and guarantee compliance with the provisions of the Executive Decree.
In the case of retirees, the 30% discount that applies to the general population will be applied and on that discount, the 20% that corresponds to them by law will be received.
The Technical Table of Medicines recommended last week to the president to invoke article 106 of Law 1 of medicines of 2001 to create a subcommittee in which the drugs that today are included in the emergency list were determined.
The Government of Laurentino Cortizo recognizes that this is a palliative while solutions are found to the problem of shortages in the health system and better prices are achieved in national pharmacies.
DARIEN NATIONAL PARK CELEBRATES 42 YEARS OF CREATION
The largest protected area in Panama and Central America turns 42 this 2022, after being created in 1980. We tell you about the Darien National Park, which with an area of 579,000 hectares is the current natural link between South America and Central America.
This national asset has an exceptional variety of habitats ranging from sandy beaches, rocky coastlines, mangroves, marshes, to tropical forests of highlands and lowlands, which are home to exceptional fauna and flora.
The Darien National Park (PND) is a unique site due to its geological origin; with an area of 579,000 hectares was created on August 7, 1980, characterized by being the largest protected area in Panama and Central America, and is considered by UNESCO as a World Heritage Site in 1981 and as a Biosphere Reserve in 1982.
On this 42nd anniversary, the Ministry of Environment highlights the natural, cultural, social and economic benefits of this important place, which is part of the National System of Protected Areas (SINAP).
This emblematic place is given the function of biological bridge between south and north of the continent; for its tropical jungle conditions, for its physical environment composed of a set of well-preserved mountain ranges separated by two wide valleys of the Tuira and Balsas rivers that are part of a highly productive hydrological mechanism; and for the natural beauty of the landscape and for its global contribution.
An outstanding feature of this national park is the rainfall, with variations from 2,000 mm in the lower parts of the basins, to 4,000 mm in the mountains in the watershed, limit on the border with Colombia.
This condition makes the Darien National Park (NDP), the main water source of the Darien region, here originate the Tuira, Balsas, Chucunaque and Sambú rivers that flow into the Gulf of San Miguel, also the Jaqué River that flows directly into the Pacific Ocean.
In addition, the Jampavadó River drains its waters to the Jurado River in Colombia. Most of these rivers are navigable during the rainy season (May-December), they are the main means of transport between the different communities of the region.
Inhabit 63% of the known fauna in Panama
With respect to fauna, in the PND is 63% of the fauna known for Panama. The mammal species identified are 174, where species of scientific importance and in danger of extinction stand out such as the jaguar (Panthera onca), the mountain male (Tapirus bairdii), the mountain pig (Tayassu pecari), the puma (Puma concolor), the spider monkey (Ateles fusciceps), the titi monkey (Saguinus geoffroyi), the mountain goat (Mazama americana), the horse bear (Myrmecophaga tridactyla). As for the avifauna, 592 species of birds have been identified, which corresponds to 63.7% of the avifauna reported for the country.
Endemism in birds
This place has two areas identified as sites of endemism in birds, the lowlands and the highlands. Some important bird species are: the harpy eagle (Harpia harpyja), the macaw (Ara chloroptera), the blue and yellow macaw (Ara ararauna), the green macaw (Ara ambigua) and the macaw (Ara severa). Also, the large turkey (Crax rubra), the crested turkey (Penelope purpurascens), the crested eagle (Morphnus guianensis).
Variety in amphibians and reptiles
In relation to amphibians and reptiles, 84 species of amphibians and 135 species of reptiles have been identified. Undoubtedly, the PND is a protected area of great importance for the conservation of the biodiversity of the country and the world. For example, of 522 species of fauna in the country that are threatened (vulnerable, endangered and critically endangered), 345 species are in the park, or 66%.
On the other hand, two indigenous tribes populate the territory of the park, which is located on the border with Colombia and Panama, is the largest protected area in Central America and the Caribbean, with an area of dense tropical forest of 579,000 hectares, marshes and tropical forests.
