Our investigations office happily sponsored the World Compliance Association’s Insurance and Compliance Conference this week. I’m not too keen on the word “Compliance” as it seems to hold a certain “you must obey” connotation and I’m a little too youthfully challenge to be taking orders. Besides, coming from a small town, we had freedoms that taught me to pushback against this type of stuff. But, many of those freedoms no longer exist, not even back in that very same little town of barely 8,000 people.

Not to mention, the original essence of insurance used to be good faith. Sure, we still need contracts, but that used to be a way to remind everyone what was finally agreed upon. Over time, the unscrupulous took us down a path we didn’t want to tread and it seems to have changed our “good faith” concept to “eternally doubtful”. But, as is the motto of the Borg (Star Trek), “Resistance is Futile”. The concept of compliance is to get everyone on board with doing things the same way and ensuring that we all work with legitimate clients who are not involved in illegal activities. Compliance has traditionally been explained by reference to the deterrence theory, according to which punishing a behavior will decrease the violations both by the wrongdoer and by others. Worldwide, banks have been fined trillions of dollars in the last 5 years. One of the more recent was AMBANK, who was fined $700 million as they were holding money that disgraced Malaysian former prime minister Nab Razak took from the government and laundered (among other offenses).

But banks aren’t the only targets for money laundering. As we’ve seen in our own disgraceful “Panama Papers” scandal, law firms are used all the time for these illegal activities. And of course, the purpose of this seminar, is to raise awareness of the steps that insurance companies are taking as well in their own uphill battle. All in all, the conference was informative and, in some cases, downright shocking. It was great to see old friends and make new. It was also good to see where our world is headed, whether we like it or not and what is being done to deter crime even in a more volatile Latin America.

The Specialized Higher Technical Institute (ITSE) opened this Wednesday, October 5, registration for those interested in studying at the School of Digital Innovation next year.

HIV-FRIENDLY CLINICS TO ARRIVE IN PROVINCES

Establishing friendly clinics that offer services in the central provinces is one of the mechanisms that the Ministry of Health seeks to establish, through the National HIV Program, with a view to the early detection of this disease.

According to Carlos Chávez, head of the STI/HIV-AIDS section of Health, it is expected that these clinics will be established in Coclé, Veraguas, Herrera and Los Santos. In these clinics, comprehensive care and timely diagnosis of sexually transmitted diseases are provided to the population, Chavez said.

He explained that all people seeking care at these clinics can apply for their quota and will be provided with the service. These facilities serve only once a week and 10 places are granted in each clinic, the results are delivered immediately.

Recently, Orlando Quintero, of the Probidsida foundation, stressed that Panama is one of the first countries affected by the epidemic in America and the second in Central America, so it is a breeding ground.

PANAMA RECEIVES 150,000 ANTI-COVID DOSES FOR CHILDREN FROM 6 MONTHS TO 5 YEARS, VACCINATION BEGINS THIS MONDAY

Panama’s Minister of Health, Luis Francisco Sucre, said the decision to approve vaccination in this age group was made after meetings with experts.

Panama received early Wednesday morning the first shipment with 150,000 pediatric doses of the COVID vaccine from the pharmaceutical company Pfizer, for children from 6 months to 5 years of age.

The vaccination day for these minors will begin from Monday, October 10 in all the facilities of the Ministry of Health (Minsa) and the Social Security Fund (CSS).

The authorities recommend that parents or guardians bring children with comfortable clothes, breakfast, with the vaccination card and an identity document of the minor.

In June of this year, Minsa indicated that Panama will acquire 380,000 doses for this age group, for an amount of B/.5,035,000.00.

THE DARIEN JUNGLE EXCEEDS THE RATE OF MORE THAN 160,000 MIGRANTS IN 2022

In the province of Darién is located one of the most dangerous jungles in Central America, according to testimonies of the thousands of migrants who, in the drama of arriving in the United States, expose their lives to conquer the American dream. This year, according to figures published by AFP, so far this year 160,690 people have crossed the 575,000 hectares of extension.

With 48,000 people, September is the month with the highest traffic despite the rains, and in the first three days of October more than 7,000 were counted.

In 2022 Venezuela and Ecuador are the countries with the highest circulation, while in 2021 the largest migratory flow came from Haiti and Cuba.

Currently, the Government of Panama maintains active Operation Controlled Flow, which provides humanitarian assistance and mobilizes hundreds of migrants daily to its Migratory Reception Stations (ERM) in the provinces of Darién and Chiriquí.

The International Organization for Migration (IOM) conducted a survey from June 17 to July 15 of this year to 230 people who have migrated. The statistics show that 94.8% were destined for the United States, while 2.2% were in Canada and 1.2% are heading towards Mexico.

TAX HAVEN, PANAMA: WHAT IS IT AND HOW DOES IT WORK?

GOVERNMENT SAYS IT WILL MEET ARREARS FROM $25 GAS TANK

DOMAIN EXTINCTION BILL RETURNS TO A SUBCOMMITTEE FOR AMENDMENT

In the first debate of Bill 625 that adopts the legislation on the extinction of ownership of illicit property, the Commission on Government, Justice and Constitutional Affairs of the National Assembly (AN) decided to send the initiative back to a subcommittee to agree on a proposal for modification.

This first subcommittee concluded that the good intentions of this bill will be acceptable as long as a deeper analysis is carried out on the impact on the courts, and their problems of application in strict respect for fundamental human rights.

“We believe that it should be reformulated for greater effectiveness in the fight against organized crime and does not violate the human rights of people who have no relationship with the crimes investigated, the bill must be drafted respecting fundamental rights,” the report states.

According to this first subcommission, the presumption of innocence is a human right that must be respected by the Panamanian State, since it is part of the international treaties that have been ratified by Panama in this area.

The Inter-American Court also indicates, in judgments issued to member states says that the presumption of innocence applies in all matters and not only in criminal matters, in that the presumption of innocence does not operate in the processes of extinction of domain, the assumption can be misleading because the doubt arises as to whether or not it is being imputed an illicit act.

Deputy Cano explained that the subcommittee agrees on the issue of fundamental guarantees, “it is an issue that as members of the Assembly we have to harmonize the project with what is established in the National Constitution.”

For his part, Deputy Leandro Ávila said that the project does not have legal congruence and does not define what will happen with institutions such as the Accounts Prosecutor’s Office.

MORE THAN A THOUSAND ANIMALS HAVE BEEN RESCUED FROM JANUARY TO SEPTEMBER

The National Police, through the units of the National Directorate of the Environmental, Rural and Tourist Police, reported that they have rescued a total of 52 domestic animals and 1,054 wildlife from January to September 2022, through 288 actions carried out.

Major Elvin Ortíz, head of the Environmental Police, said that so far 114 verifications and 55 inspections have been carried out on complaints of animal abuse where 67 have been transferred to a veterinary clinic so that they can receive due attention. These rescues have been carried out in coordination with environmental authorities and foundations dedicated to animal welfare, in sectors such as Panama Oeste, Colón, San Miguelito and others in the country.

Regarding the actions carried out in protected areas such as the Soberanía National Park and the Barro Colorado Reserve, Ortíz indicated that around 4 cases of illegal hunting have been detected, where 17 firearms have been seized.

DGI STARTS UPDATE CAMPAIGN ON TAXPAYER REGISTRATION

DRAFT LAW CREATING WOMEN’S MINISTRY MOVES TO THIRD DEBATE

The representative of the Catholic Church, Maribel Jaén reiterated, from the facilities of the Technological University of Panama, that it is complying with what was previously agreed at the dialogue table that was established in the first phase in Penonomé, province of Coclé.

The church report pointed out that the businessmen, before sitting at the Dialogue Table, conditioned a series of rules such as postponing the dates of October 6 and 7 for the start of the dialogue, having symmetry in participation, and others. While the Alliances have reiterated that the agreements will be maintained, with the 8 main issues to be addressed, with their alternates in each sector, so they reject the request of the private company.

It should be remembered that in a meeting held this Wednesday, October 5, the Alliances and the Executive Body reaffirmed their willingness to comply with what was agreed, and since this Thursday, October 6, at 10:00 a.m., they have met to coordinate the methodology of the dialogue and choose a facilitator.

At the beginning of the meeting, Jorge Guzmán, of alianza Pueblo Unido por la Vida, questioned the breach of agreements to start this transition phase, such as the absence of SERTV for national transmission and reminded the Government that it is not a judge or party, but that everyone decides at the table.

300 HECTARES RECOVERED FOR THE STATE IN CHIRIQUÍ, A HIDDEN ASSET SINCE 1914

300 hectares located in El Pianista, district of Boquete, were restored as heritage of the Panamanian State.

Some 300 hectares located in the sector known as El Pianista in the district of Boquete, province of Chiriquí was restored as heritage of the Panamanian State.

After that, through an anonymous complaint to the Ministry of Economy and Finance in 2010, the acquisition of the territory more than a century ago was announced, by individuals, in clear contravention of Law No. 20 of January 31, 1913, on vacant and pardoned lands, and to the detriment of the State.

The Public Prosecutor’s Office of Panama, emphasizes that the Superior Prosecutor’s Office Specialized in Civil, Agrarian and Family Affairs, managed to declare the existence of a hidden property in this case.

Through the civil process of recovery of State land, the irregularities that occurred since 1914, the date on which farms were born as private property, were revealed, without following the procedure provided for in the law.

Therefore, in an appeal hearing, the First Superior Court of the First Judicial District of Panama, ruled that the sentence be annulled in the first instance.

The senior prosecutor, Juan Ruíz testified that the 300 hectares were acquired more than a century ago by individuals, in breach of the established rule of Law no. 20 of January 31, 1913, which emphasizes abandoned territories.

Article 80 of the Tax Code states:

“They are hidden goods of the State, not only those simply abandoned or hidden in their material sense, but also those in respect of which their primitive character of national property has become obscured.”

Because of defending the interests of the State or the municipality, Resolution No. 31 of December 7, 2020, creates the Superior Prosecutor’s Office Specialized in Civil, Agrarian and Family Matters.

The legal concept that is regulated in article 80 of the Tax Code is used when the character of the national property has become obscure, and the assets denounced are in the hands of individuals.

FIRST ROBOTIC SURGERY OF THE PUBLIC SECTOR WILL BE CARRIED OUT ON OCTOBER 19 IN THE CITY OF HEALTH

Hugo RAS, a team that will allow the development of robotic surgeries, arrives at the City of Health.

This October 19, the first robotic surgery will be performed in the operating rooms of the Cardiovascular and Thoracic Institute of the City of Health.

With this procedure, Panama is positioned as the first country in Latin America to perform robotic surgery in the public sector, according to Alex González, director of Medical Benefits of the Social Security Fund (CSS).

Miguel Ángel Cáceres, coordinator of the Robotic Surgery program, explained that the surgery will be carried out with Hugo RAS, a robot that allows the opening of a patient, which is regularly 35 to 40 centimeters, with this technology to be between 8 to 11 millimeters.

In addition, the patient’s recovery, which regularly takes between 30 and 60 days, takes between 7 and 15 days.

According to the CSS, the City of Health will have five surgeons and specialists trained to carry out the surgery with Hugo RAS.

Currently this hospital center has the supplies for the first 120 surgeries.

The staff will be in the two operating rooms, including nurses, a biomedical team from the robotic equipment contractor, surgeons with their assistants, anesthesiologists, instrumentalists, circulators and assistants in case of more complex surgeries.

The first surgery to be performed with Hugo RAS in the City of Health is scheduled for the fourth week of October

Hugo RAS will allow oncological, urology and gynecology interventions. In addition, it is designed for more precise, fine, delicate and minimally invasive general surgeries.

Robotic equipment is characterized by being accurate, which allows specialists to enter spaces where manual skill does not reach.

Pediatric surgeries

In addition to robotic surgery, the first cardiac surgery on children will also be performed in the City of Health this month.

“We will no longer have to send so many children to operate outside because they will have the tools and equipment,” said Dr. González.

According to the doctor, the main and most complex services carried out by the Hospital Complex and the Hospital of Pediatric Specialties, will be transferred to the City of Health.

Advances of the City of Health

Previously, the CSS indicated that this October several of the infrastructures that make up the City of Health will be delivered. The work has an 86% progress.

It is expected that before October 15 the third phase will be inaugurated, which includes the administration building, the outpatient room with 220 offices and a ground floor that has several commercial premises.

The Atrium, the teaching area, the cafeteria and the Critical Adults building will also be inaugurated, which includes a space for the care of patients with Strokes, area for burn patients, operating rooms and 9 intensive care rooms.

The complete delivery of the largest hospital center in the country is expected to be on December 16, 2023, after more than 8 years of construction.

LAZOTEA Restaurant and Rooftop for Brunch

Between trips, vacation and dieting, I’ve not been out to many restaurants lately. But last Sunday morning, our Queen needed to feel extra special and asked her humble servants to accompany her to brunch. Always on the lookout for something that we’ve never done before, we reached beyond the normal hotel brunch specials, looking for something unique and we definitely found that with LAZOTEA Restaurant and Rooftop.

Located on the edge of Casco Viejo, or the “beginning” of it depending on where you’re coming from, it’s right at the entrance to Casco just as you get off of the Cinta Costera. (Golden Frog used to be next door.). Aaaaaanywho, we self-parked and paid the local 92-year old “watchiman” to care diligently for our vehicle at a mere $5.00. I should add that they do have VIP parking, even on Sundays, but no-one other than us are allowed to touch the Queen’s car… … NO ONE.

Their brunch menu is very nice. The prices are a little high, but the service is impeccable. If you wanted the full brunch special, it’s actually only $35.00 and offers a selection of breads, a Fruit Parfait, Eggs Benedict (of several variations) and a Creme Brulée for desert.

The individual menu is available and as boys will be boys, they ordered pancakes which I was reluctant to allow them to have as it includes a portion of ice cream, Queen Sayira had the Lobster Tacos (holy yumminess!!) and I ordered a Fruit Parfait and Bacon Benedicts. We could base this solely on my boys’ review – they both wanted more, but mean dad said “no”. I mean, I’m still dieting and well, if I have to suffer, then they should too, am I right??

Not often do we get to feel like Royalty in Panama, but LAZOTEA did exactly that for us.

Final call? We’ll be back. But, I think I’ll just go with my queen, so we can indulge in the Open Mimosas or Open Aperol Spritz for just $20.00. We wouldn’t want our kids to watch us as we acted silly and stupid… … just the perfect strangers who treat us like royalty. Has!
