Living in Panama, even with its high-rise buildings and fancy restaurants, is still a third-world country.  The suppression of uncomfortable ideas may be common in politics, but there’s no place for it in the endeavor of truth and transparency.  Marketting Panama as being all rainbows in an easy-going environment is deception at its finest and has been the reason that so many have invested blindly without taking into consideration the other side to that otherwise very shiny coin.  I love Panama and have learned to tolerate much of the idiosyncrasies that define Panama negatively.  This last week has been for me the exact definition of what people can expect if they´re not prepared, or if they’ve simply lost touch with reality.  I had temporarily lost touch with reality, although much of it was beyond my control.  Here’s a snippet from this last week’s happenings in my world…

DIASP – oh how I loathe thee.  In 2016, I requested a renewal for my weapons permit.  If I wrote the whole ordeal on how that went, it would practically be a book of its own.  I finally got my permit in hand on April 28, 2023, but not after the previous government putting a hold on all permits, a few DIASP-connected government employees being fired or arrested for wrong-doings, being lied to (out of their own ignorance, not intentionally) saying that the FBI still had to chime in before they could get me my permit, which was just a load of pupu… …the fact was that they lost my entire file.  Not just the renewal request, but the ENTIRE history of me ever having a permit.  So, I had to hire a lawyer, recreate the file, redo the entire process and finally get my permit after 7 years waiting.

Novey – oh how I loathe thee even more.  Actually, I can’t stand hardly any of the hardware stores in Panama.  I’m building a MONSTER closet right now and needed 2x 3-meter rails for a set of 4 sliding doors that I’m including.  Because the rails are “in the warehouse”, they give you a piece of paper after confirming that they have them in stock.  You then take this piece of paper to the register, pay for it and then go outside to the reception of materials area for them to give you your stuff.  However, this time, they didn’t have my stuff.  Although the computer indicated that they had 3 rails in stock, they actually only had 1; ain’t that just marvelous?  I eventually had to drive over to another Novey, ask them to confirm if they had the extra rail in their system and confirm it physically available.  Once they did, wait for them to confirm with the other Novey store… …this whole fiasco took 4 hours of what should have been 15 minutes of shopping.

That’s not to mention, what happens when a water pipe in your house ruptures, what to do if your remodeling crew screws up tile installations, and much much more…  maybe I’ll bore you with the details in next week’s newsletter.

Am I a whiny little baby?  Maybe… possibly… but it doesn’t detract from the fact that in Panama, you’re going to need a lot of patience for what should be standard tasks.

PANAMA AND INDIA, READY TO CREATE PHARMACEUTICAL ALLIANCE

The Foreign Minister of India, Subrahmanyam Jaishankar with the President of Panama, Laurentino Cortizo.

The President of the Republic, Laurentino Cortizo, held a meeting with the Minister of External Affairs of India, Subrahmanyam Jaishankar, to discuss topics such as commercial exchange between the two countries, technology, and the pharmaceutical industry, among others.

In a statement from the Presidency, it was reported that it was the first time in 60 years of diplomatic relations that an Indian foreign minister visited Panama. India is considered the largest democracy in the world and the fifth global economy.

During the meeting, President Cortizo and the Indian Foreign Minister discussed the willingness to form an alliance with the Indian pharmaceutical industry to achieve quality, effective, and cheaper medications for Panamanians, which is a goal of the current administration.

In addition, they discussed the commercial exchange between Panama and India and the advantages that our country offers for the establishment of more companies. They also talked about opportunities for cooperation and our interest in developing a center of technological excellence and innovation.

Earlier, the Indian Foreign Minister offered a floral tribute at the statue of the father of Indian independence and advocate of nonviolent resistance, Mahatma Gandhi. He also held a joint press conference with Panama’s Foreign Minister, Janaina Tewaney.

In 2022, India became the fifth largest economy in the world, experiencing a tremendous economic growth. The populous Asian country displaced the United Kingdom to become the sixth largest economic power.

The only countries that surpass India as economic powers are the United States, China, Japan, and Germany. Wheat and rice are their main agricultural products, and they excel in petroleum, pharmaceutical, electronic, textile, and clothing products, among other manufacturing sectors.

This month, according to the latest projections from the United Nations, India became the most populous country in the world with 1.428 billion people, surpassing China.

President Cortizo was accompanied in the meeting by Foreign Minister Janaina Tewaney, the Administrator of the Government Innovation Authority, Luis Oliva, and Saleh Asvat, Secretary of the Public-Private Association.

CITIZEN IDENTIFICATION TOUR FOR THIS APRIL 29, 2023

Citizen identification tours.

The next citizen identification and civil registration tour carried out by the Electoral Tribunal (TE) will take place at the Pedro J. Sossa School, Calidonia district, Panama City, on Saturday, April 29, during the hours of 8:00 a.m. to 1:30 p.m. according to the TE’s identification tour announcement.

The TE invites neighboring communities to make their renewal and first-time ID registration procedures.

For the renewal of an expired ID document, users must bring the expired document and for youth and first-time identification documentation procedures, one of the parents must present a copy of their ID and their valid identification document.

According to the Electoral Tribunal, from March 4 to April 23, only in the province of Los Santos, 591 identification tour procedures were carried out.

During these tours, Civil Registry collaborators processed 239 duplicate IDs, 87 renewals, and 65 youth IDs.

WARRANTY ON APPLIANCES, THE MOST COMMON COMPLAINT OF ACODECO

There are also complaints about lack of information and hidden defects.

The Consumer Protection and Competition Defense Authority (Acodeco) reported on Monday that failure to comply with warranties is the main reason for complaints about household appliances and electronic equipment that it receives.

According to statistical reports from Acodeco’s complaint board, from January to March of this year, 38 complaints were received for the sale of household appliances and electronic equipment, for a total amount of $30,176.91.

Of these cases, 26 were processed for failure to comply with warranties, for $18,560.57.

Other reasons addressed include lack of information, hidden defects, refund of money, and contract resolution.

It should be noted that from 2019 to March 2023, complaints filed with Acodeco regarding household appliances and electronic equipment rank second in the statistics, with 944 cases for a total of $571,977.76.

Likewise, in complaints resolved in favor of consumers, they rank second, with 846 for a total amount of $450,779.08.

In light of this situation, the institution reminds consumers that it is important for the terms and conditions to be clearly and precisely stated in writing, even when the purchase is made online.

Acodeco emphasizes that every complaint must be accompanied by supporting documentation, especially proof of payment by the consumer.

It is necessary to provide a copy of the consumer’s ID, warranty certificates, invoice, as well as anything else that can help support the case presented to the institution, and most importantly, to provide the originals for verification.

MEDUCA: LAW THAT BENEFITS TEACHERS APPROVED

MEDUCA: Law that benefits teachers approved.

The National Assembly approved, in the third debate, bill 815 that establishes guidelines for the transformation, improvement, and well-being of teachers, and other provisions, which was presented by the Minister of the Ministry of Education (MEDUCA), Maruja Gorday de Villalobos.

The National Assembly approved, in third debate, bill 815 that establishes guidelines for the transformation, improvement, and well-being of teachers, and other provisions, which was presented by the Minister of Education (MEDUCA), Maruja Gorday de Villalobos.

The initiative, which consists of 20 articles, proposes general guidelines for the formulation, development, and implementation of public policies related to the permanent updating, transformation, and improvement of the educator, taking into account the characteristics of each educational region and the best practices to achieve excellence in the Panamanian education system.

Another article states that, in order to increase the motivation and impact of the teacher improvement work, the following guidelines will be applied: orientation on understanding and relevant decisions to improve the quality of life of the teacher, quality of useful methodological or technological tools, activities in their educational centers, management of professional growth opportunities, among others.

Also, to contribute to the implementation of public policies, in a stable and long-term manner, the MEDUCA will promote the creation of an Institute for the Improvement and Well-being of Teachers, as a public interest association, in accordance with Law 39 of 2018.

Law had been expected by teachers

Gorday de Villalobos stated that the 815 bill provides guidelines for public policies for the improvement and development of competencies and the well-being of teachers. It is something expected and set out in Copeme, the Government Plan, and the commitments that exist in the improvement and updating of teachers.

Julio Escobar, President of the Foundation for Educational Excellence and Honorary Presidential Advisor in education, science, technology, and innovation, stated that “it is a great step, it is a substantial improvement of the education system, the creation of the Institute for the Improvement and Well-being of Teachers, will allow greater agility in the process of improving teachers,  allows for longer training periods, also allows for the technical training of personnel and maintains the Directorate of Improvement in charge of public policies for improvement and the state resources to achieve first-level objectives and quality.”

This law is aimed at all educators in the official and private sector of the first and second levels of education of the regular and non-regular subsystem, and to educators who have completed their training but have not entered the formal education system.

The Ministry of Education (Meduca), through the National Directorate of Training and Professional Improvement, is the instance for the formulation, monitoring, and updating of public policies in this matter.

2024 DRY SEASON COULD BE HOTTER THAN 2023

High temperatures have been strongly felt this year.

If this year’s dry season has felt exhausting, next year’s could be worse. With projections of an El Niño phenomenon looming for the second half of 2023, the situation could be more intense in the first months of next year.

Ligia Castro de Doens, Director of Climate Change at MiAmbiente, emphasized that everything will depend on the intensity with which this climatic event occurs.

Currently, the phenomenon is developing without causing major disruptions to the normality of the season, the official noted.

“In 2024, we will have a hotter and perhaps longer dry season than this one, depending on whether El Niño is moderate or strong,” she said.

Castro pointed out that, according to the World Meteorological Organization, March has been the second-hottest March on record.

In this regard, she explained that it would not be surprising if April is also the second or hottest due to the high temperatures experienced.

The global average temperature has increased by 1.3°, and it was expected that by 2050 it would not reach an increase of 1.5°, which shows how the climate crisis is accelerating.

Projections indicate that there is over a 60% chance that the El Niño phenomenon will intensify starting in July.

The climate event has different effects on the continent. While there are more rains in the Pacific of South America, in Central America, these decrease, resulting in less precipitation.

El Niño/Southern Oscillation (ENSO) is a natural phenomenon characterized by the fluctuation of ocean temperatures in the central and eastern equatorial Pacific, associated with changes in the atmosphere. This phenomenon has a significant influence on the weather conditions of different parts of the world.

DEVIATIONS ON TECAL: WHEN DO THEY START AND HOW LONG WILL THEY LAST?

Detours in El Tecal.

According to the official statement issued by the Ministry of Public Works (MOP), there will be road diversions for cars at the entrance of the Tecal community in Arraiján, which corresponds to the end of the Chumical community, from Friday, April 28 until May 31, 2023, until the demolition works of the existing road are completed.

These works correspond to the project: Study, design, construction, and financing for the rehabilitation and expansion of the Autopista-Puerto Vacamonte highway in the province of Panama Oeste.

FIRST DEBATE: JAIL FOR ATTACKERS OF ELDERLY ADULTS

The proponent of the bill is Deputy Mayín Correa.

The Government, Justice and Constitutional Affairs Committee, chaired by Deputy Leandro Ávila, approved in first debate Bill 999, which adds aggravating circumstances to the Penal Code, related to the punishment with jail sentences for those who kill or assault elderly people.

The sponsor of Bill 999, Deputy Mayín Correa, indicated that “those who beat or kill our elderly people, from now on, to rob them, will pay with jail sentences, the same years as if they had pulled out a gun to kill.”

“This aggravating factor will now have a greater punishment according to the Penal Code. Those who beat or kill an elderly person, they should know that they will have more years in jail than any other crime, we will have to be tougher with people who do not respect age,” added Correa.

The committee also approved, in first debate, Bill 858, which modifies the Criminal Procedure Code, presented by Deputy Fátima Agrazal, related to plea agreements for pedophiles and rapists, whose cases are on the rise.

“Allowing plea agreements to go from the maximum penalty, pedophiles and rapists are making a mockery of society and they go free immediately by agreement. I feel that some authorities do not take seriously the cases that happen in our country,” said Agrazal.

She emphasized that “allowing inmates to try to reintegrate into our society with early release does not do justice to these children who are dead inside, to these children who trusted a family member, neighbor and, in the silence of that familiarity and trust, perpetrated atrocious acts.”

In addition, this legislative committee received the report made by committee technicians on Bill 635, rejected as inconvenient by the Executive Branch, which modifies and adds articles to the Judicial Code related to the auction of movable and immovable property and approved it in first debate, and recommended that the plenary approve it by insisting.

The Government, Justice and Constitutional Affairs Committee also approved in first debate Bill 797, which adds several articles to the Penal Code related to invasions of immovable property, which changed the word “invader” to “those who violently intrude”.

They also held the first debate on Bill 995, which modifies article 288-G of Law 70 of 2019, which amends the Penal Code.

ETELVINA DE BONAGAS RE-ELECTED AS RECTOR OF UNACHI

Etelvina de Bonagas was re-elected as rector of UNACHI.

By majority of votes, Etelvina de Bonagas has been re-elected as Rector of the Autonomous University of Chiriqui (UNACHI) for another 5-year term; the declaration of her victory was made during midnight of Thursday, April 26 at 11:00 pm, being declared as a clear winner in the teaching vote tables.

Her face couldn’t hide the joy and satisfaction for the victory, Etelvina Medianero de Bonagas will be in charge for the third consecutive period; in her first statements, she called for unity to work in a coordinated way for the benefit of higher education in the province of Chiriqui..

60% of voters in UNACHI are teachers.

Preliminary reports show that Etelvina de Bonagas would have been re-elected with the favorable vote of 60% of the faculty and 10% of the administrative staff. On the other hand, her opponent, Professor Edwin Samudio, would have received the majority of votes from the students, representing the other 30%.

Meanwhile, there was little support at the polls for the third candidate, Professor Pedro González Beerman. Despite this, de Bonagas will hold the position until 2028. In order to be re-elected for a third term, the law that allows Unachi to extend a rectorate to a third term was changed, a highly controversial law in the National Assembly.

PANAMA QUALIFIES AS A NOISY CITY

26 April, International Noise Awareness Day.

Noise pollution, which aggressively affects many cities, destroys well-being and damages physical and mental health, warns Giovanna Troncoso, president of the Panamanian foundation “Hearing is Living.” Troncoso proposes promoting self-care and establishing a new relationship with noise through education.

“The issue of noise doesn’t just concern those born with hearing loss. The reality is that many more people lose their hearing after they’re born,” says Troncoso in an interview with EFE on the occasion of the commemoration of International Noise Awareness Day on April 26.

The purpose of this annual event, celebrated every last Wednesday in April, “is to reflect,” because everyone is “part of the problem and the solution.”

“We all make noise and we can all stop making it,” she emphasizes.

Troncoso invites everyone “to join a minute of silence #solounminuto on April 26, to become aware that noise is harmful and that we have the power” to change the situation.

The president of the “Hearing is Living” Foundation, a non-profit organization founded 15 years ago, noted that the World Health Organization (WHO) indicates that “any noise above 80 decibels” already poses “an imminent risk to hearing.”

Noise caused by trucks carrying construction materials, which usually pass through Panama City, reaches 80 decibels. A car horn, which is frequent in the Panamanian capital, can reach 110 decibels.

These are common noises even in one’s own home or neighborhood, with neighbors in their homes or in common areas with shouting or music at a volume that disturbs.

This situation of excessive noise in condominiums and neighborhoods “becomes a problem (that) must be addressed by different sources (…) and this is done with laws that are enforced.”

“Panama is rated as a noisy city,” says Troncoso, who recalls that years ago “sound measurements were taken in different places and the city reached noise levels higher than New York City.”

A report by the United Nations Environment Programme (UNEP) published in 2022 indicated that acceptable noise levels are exceeded in many cities around the world, including Algiers, Bangkok, and New York City.

The UNEP report “Boundaries 2022: Noise, Flames and Imbalances” noted that unwanted, prolonged, and high-level sounds from traffic, rail, or leisure activities harm health and well-being.

“Exposure to continuous noise causes insomnia, irritability, lack of concentration, hypertension, gastrointestinal problems (…) or it can drive you crazy, it can really harm you,” says Troncoso.

The auditory organ also faces the passage of time: after 40 years of age, a person loses an average of 1% of their hearing every year, she adds.

Self-care and education

The key factor to put an end to noise pollution is to educate ourselves “as a society, in terms of what noise is, when it is harmful, and what to do”.

The Hear to Live Foundation has launched the school guide “More silence, less noise” so that “teachers can teach these new generations to relate differently to noise, to understand that noise is harmful, and to know how to avoid it”.

“Suddenly I had to learn to wear protective earmuffs, intracanal plugs, to move away from the sound source. I can control how often I am exposed to it. These are all factors that I can control,” she emphasizes.

The foundation will offer a free virtual teacher training session in May, with five medical organizations from Europe and Latin America, “to present an update on the attention given to hearing disabilities”.

The training session “is aimed at the medical community, teachers, therapists, and parents. We already have more than 390 registered participants from more than 16 countries,” she highlighted.

PROJECT OF EXTINGUISHMENT OF DOMINION MOVES TO SECOND DEBATE

Committee on Government, Justice and Constitutional Affairs.

The Government, Justice and Constitutional Affairs Committee approved in first debate Bill 625, which adopts the Extinction of Ownership of Illicit Property, and will receive comments to reorganize the proposal.

During the meeting, the President of the Legislature, Crispiano Adames, indicated that there is enough time to discuss, in second debate, the initiative that seeks to extinguish the financial muscle of organized crime.

He pointed out that the Extinction of Ownership norm was widely agreed upon in the technical committee meetings, so it is interesting that in the second debate, the proposal of the group of consultants and experts in criminal investigation, which refers to the private sector corruption crime, be evaluated.

For his part, the President of the Government, Justice and Constitutional Affairs Committee, Leandro Ávila, stated that the project will continue to undergo modifications in second debate, so they will continue to work towards achieving a comprehensive norm to combat organized crime.

The Secretary General of the Ministry of Public Security, Jonathan Riggs, highlighted the political will for the approval of the norm and hopes that the deputies will approve it in second and third debate.

Deputy Corina Cano, who chaired the technical committee on this bill, stated that the catalog of crimes was focused on those related to organized crime.

For lawyers Víctor Orobio and Ariel Corbetti, the opportunity to participate and contribute to improving the document presented by the Ministry of Security was very profitable, since what was approved encompasses much of what was discussed in the technical committee, but it can still be improved further.

It is expected that the bill on Extinction of Ownership will be discussed in a second debate soon.

TAX EXEMPTION ON MORTGAGE LOANS EXTENDED UNTIL 2028

Homes with occupancy permits issued from January 1, 2017 will be eligible for the benefit.

The exemption in mortgage loans with preferential interest rates has been extended until 2028, with the approval in third debate of project 1009.

The price range ranges from $45,000 to $180,000.

The initiative proposed by deputies Crispiano Adames and Alina González modifies Law 94 of 2019 and Law 3 of 1985, which establishes a regime of preferential interest rates in certain mortgage loans.

What does it consist of?

These adjustments allow for the temporary extension of the deadline to apply for benefits and the exemption from the Transfer Tax on Movable Property in the first sale transaction, as recognized in Law 106 of 1974, until August 1st, 2028.

The preferential range mentioned cannot exceed:

  • 4% on housing loans for a non-renewable period of 10 years, whose registered value at the time of financing is greater than B/. 45,000 and does not exceed B/. 120,000.
  • 2% on vertical multifamily housing loans for a non-renewable period of 5 years, whose registered value at the time of financing is greater than B/. 120,000 and does not exceed B/. 150,000 nationwide.
  • 1.5% on vertical multifamily housing loans for a non-renewable period of 5 years, whose registered value at the time of financing is greater than B/. 150,000 and does not exceed B/. 180,000 nationwide.

Homes whose occupancy permits were issued from January 1st, 2017, until the date of promulgation of this law can also benefit from this, but only for mortgage loans granted until June 30th, 2024.

FIRES ENDANGER THE CONTINUITY OF THE ELECTRICAL SYSTEM

The company ETESA has received reports of these fires in areas very close to the electricity transmission lines.

The Electric Transmission Company (ETESA) warns about the risk that grass fires near transmission towers and substations represent.

Last weekend, the Panama Fire Department responded to a vegetation fire near the Panama II substation located in the Rana de Oro sector of the Pedregal district in the capital city.

This situation endangered the continuity of the electrical system, warned ETESA’s manager, Carlos Mosquera Castillo.

The company has received reports of these fires in areas very close to the electrical transmission lines, which puts the national electrical system at risk, he warned.

The exposure of towers and substations to flames increases the risk of blackouts.

In addition to damages and blackouts, this practice harms the daily activities of Panamanian society and the country’s economy.

MORE THAN 13,000 VISITORS FLOCKED TO CHIRIQUÍ’S PROTECTED AREAS SO FAR IN 2023

Thousands of visitors flocked to Chiriquí’s protected areas so far in 2023.

Statistics provided by the protected areas section of the Ministry of Environment (MiAmbiente) in the province of Chiriqui, revealed that about 13,703 people visited various tourist attractions in the province during this first quarter of 2023.

According to the entity, the main sites visited by people were: the Golfo de Chiriqui Marine National Park, Volcan Baru National Park, La Amistad International Park, and the Playa La Barqueta Agricola Wildlife Refuge.

Most of these tourists were national. According to the entity, this number of visitors is distributed as follows:

  • Volcan Baru National Park: 6,095 tourists
  • Golfo de Chiriqui Marine National Park: 5,841 visitors
  • La Amistad International Park: 123,000 people
  • Playa La Barqueta Agricola Wildlife Refuge: 644 tourists

In the case of Volcán Barú National Park, in order to visit it, people must reserve a spot which should be sent to the email address rcastillo@miambiente.gob.pa or parquevolcanbaru@miambiente.gob.pa.

DIGITAL PLATFORMS PROJECT APPROVED IN FIRST DEBATE

The bill would regulate digital transportation platforms.

The Communication and Transportation Commission of the National Assembly approved in first debate the bill 986 that would regulate digital platforms in the luxury taxi service.

The law would require digital platform drivers to belong to a selective public transport provider.

Abel Beker, president of the commission, explained that digital platforms have been operating in the country for more than seven years and what is being sought is that all sectors comply with Panamanian regulations.

The congressman believes that the project is fair for everyone and that no one should evade paying taxes.

For his part, Congressman Luis Ernesto Carles, stated that some providers want to continue denying the opportunity for transportation to modernize, in such a way that the user chooses the good service.

Meanwhile, members of the Union of Urban Taxi Drivers (Sicotaur) expressed that it is regrettable that arbitrary decisions are being made and that everyone is approving them without taking into account the needs of all the people in the industry..

They mentioned that this will be a lucrative business and it must be clear that the regulatory entity is the Transit and Land Transportation Authority (ATTT) and it has not given any signals on this issue, because it is an accomplice to all these arbitrary descisions.

Additionally, they pointed out that humble transporters have not been taken into account in this bill; only the “mafia” of transportation’s leadership has been considered.

Meanwhile, the Free Consumers Association of Panama (ACL) has stated that the bill does not seek to protect the rights of users, nor of the platform drivers, nor of the taxi drivers themselves, since all it does is favor the so-called transport concessionaires.

They consider that what is wanted is for the country to go back 30 years and for digital platforms to stop being a private service to become a bad public service.

After a rough week, I love looking back to the wisdom of some of the comedians that made an important impact on my life and way of thinking. One of those comedians is Steven Wright. So without further ado, I give you just a touch of the Genius of Steven Wright!
