Our investigations office happily sponsored the World Compliance Association’s Insurance and Compliance Conference this week.  I’m not too keen on the word “Compliance” as it seems to hold a certain “you must obey” connotation and I’m a little too youthfully challenge to be taking orders.  Besides, coming from a small town, we had freedoms that taught me to pushback against this type of stuff.  But, many of those freedoms no longer exist, not even back in that very same little town of barely 8,000 people.

Not to mention, the original essence of insurance used to be good faith.  Sure, we still need contracts, but that used to be a way to remind everyone what was finally agreed upon.  Over time, the unscrupulous took us down a path we didn’t want to tread and it seems to have changed our “good faith” concept to “eternally doubtful”.  But, as is the motto of the Borg (Star Trek), “Resistance is Futile”.  The concept of compliance is to get everyone on board with doing things the same way and ensuring that we all work with legitimate clients who are not involved in illegal activities.  Compliance has traditionally been explained by reference to the deterrence theory, according to which punishing a behavior will decrease the violations both by the wrongdoer and by others.  Worldwide, banks have been fined trillions of dollars in the last 5 years.  One of the more recent was AMBANK, who was fined $700 million as they were holding money that disgraced Malaysian former prime minister Nab Razak took from the government and laundered (among other offenses).

But banks aren’t the only targets for money laundering.  As we’ve seen in our own disgraceful “Panama Papers” scandal, law firms are used all the time for these illegal activities.  And of course, the purpose of this seminar, is to raise awareness of the steps that insurance companies are taking as well in their own uphill battle.  All in all, the conference was informative and, in some cases, downright shocking.  It was great to see old friends and make new.  It was also good to see where our world is headed, whether we like it or not and what is being done to deter crime even in a more volatile Latin America.

HIV-FRIENDLY CLINICS TO ARRIVE IN PROVINCES

HIV testing.

Establishing friendly clinics that offer services in the central provinces is one of the mechanisms that the Ministry of Health seeks to establish, through the National HIV Program, with a view to the early detection of this disease.

According to Carlos Chávez, head of the STI/HIV-AIDS section of Health, it is expected that these clinics will be established in Coclé, Veraguas, Herrera and Los Santos. In these clinics, comprehensive care and timely diagnosis of sexually transmitted diseases are provided to the population, Chavez said.

He explained that all people seeking care at these clinics can apply for their quota and will be provided with the service. These facilities serve only once a week and 10 places are granted in each clinic, the results are delivered immediately.

Recently, Orlando Quintero, of the Probidsida foundation, stressed that Panama is one of the first countries affected by the epidemic in America and the second in Central America, so it is a breeding ground.

According to Quintero, before the most affected age was 30 onwards, but now they are between 20 and 29 years old, and even minors whose cases have already occurred in the Ngäbe Buglé region, where the rates are increasingly high.

In fact, during 2021, 644 cases of HIV/AIDS were diagnosed in young people in Panama, according to figures from the Ministry of Health.

Breakdown of cases in young people

·    4 cases (0.29%) among young people aged 10 to 14 years

·    69 cases (5.1%) among young people aged 15 to 19

·    276 cases (20.2%) among young people aged 20 to 24

Panama’s Minister of Health, Luis Francisco Sucre, said the decision to approve vaccination in this age group was made after meetings with experts.

Panama received early Wednesday morning the first shipment with 150,000 pediatric doses of the COVID vaccine from the pharmaceutical company Pfizer, for children from 6 months to 5 years of age.

Previously, Dr. Eduardo Ortega explained that “with Moderna, the minor requires only two doses of the vaccine and can be considered fully immunized two weeks after the last dose.” In addition, he indicated that “a minimum interval of four weeks after the first dose” is needed to apply the second.

Health Minister Luis Francisco Sucre said the decision to approve vaccination in this age group was made after meetings with experts.

TAX HAVEN, PANAMA: WHAT IS IT AND HOW DOES IT WORK?

Countries considered as tax havens are limited by foreign tax authorities when considering the fact as an illicit activity.

It is known as a tax haven to the country that offers foreign persons or companies little or no tax burden especially favorable to those who take advantage of this practice who do not reside in the Country or State; these territories usually provide minimal financial information to foreign tax authorities that consider this act as public immorality to want to hide the true amounts of money that is possessed and immediately associated with that fact as a illicit activity.

In this way, These Nations are determined to have a Tax Haven for avoiding the responsibility of paying tax taxes that the laws of a State impose to maintain the balance between harmony and the obligations existing in it; such as public spending, payment of debts and investments.

Tax haven

What does it mean for a country to be a tax haven?

For those who know the subject, the countries considered as tax havens are territories where elites and large transnational companies deposit their money, in secret bank accounts, to evade the payment of taxes in their own countries.

In this way, illicit financial flows are generated that encourage corruption and money laundering, being frowned upon by the European Union, as well as the Organization for Economic Cooperation and Development (OECD) that include these countries in a blacklist.

Panama on the European Union blacklist

Earlier, it was announced that the European Union (EU) revised its list of non-cooperative countries and territories for tax purposes, in which it added Anguilla, Bahamas and Turks and Caicos; and decided to keep Panama and eight other countries.

The report mentions that Panama has deficiencies with respect to its rating in the assessment on tax information exchange of the Global Forum on Transparency and Exchange of Tax Information and notes that the country has a harmful foreign source income exemption regime.

GOVERNMENT SAYS IT WILL MEET ARREARS FROM $25 GAS TANK

Gas tank.

The National Government, through a statement, indicated that it will comply with the late payments to the importer and supplier of cooking gas, Petro Port, for the subsidy of the tank of 25 pounds to avoid shortages.

“The Executive is converting the credit approved on September 29 by the National Assembly into a liquid payment and will proceed to pay through the administrative procedure what has already been approved, given the urgency presented by the distributors of the 25-pound gas tank,” the statement said.

Petro Port, in charge of the distribution of this product through a statement, stressed that it notified the National Secretary of Energy of this situation in a timely manner, about the status of the butane gas inventory in the National Strategic Reserve.

They explained that the Budget Committee of the National Assembly approved to  the Ministry of Economy and Finance (MEF), five transfers of departure for a total amount of $ 114, 297, 140.00, of which an amount in the amount of 60 million dollars would reinforce the item corresponding to the subsidy of the gas tank.

The Government assures that it has subsidized for 30 years, the sale of the 25-pound gas tank, which in Panama is marketed in B/.4.37 and is exclusively for domestic use. Without this state contribution, the sale price would be B/.16.63.

DOMAIN EXTINCTION BILL RETURNS TO A SUBCOMMITTEE FOR AMENDMENT

Government Commission during the debate of the bill of extinction of domain.

In the first debate of Bill 625 that adopts the legislation on the extinction of ownership of illicit property, the Commission on Government, Justice and Constitutional Affairs of the National Assembly (AN) decided to send the initiative back to a subcommittee to agree on a proposal for modification.

The project was already in a subcommittee made up of deputies Corina Cano, Crispiano Adames and Juan Diego Vásquez, and today delivered a report.

This first subcommittee concluded that the good intentions of this bill will be acceptable as long as a deeper analysis is carried out on the impact on the courts, and their problems of application in strict respect for fundamental human rights.

We believe that it should be reformulated for greater effectiveness in the fight against organized crime and does not violate the human rights of people who have no relationship with the crimes investigated, the bill must be drafted respecting fundamental rights,” the report states.

According to this first subcommission, the presumption of innocence is a human right that must be respected by the Panamanian State, since it is part of the international treaties that have been ratified by Panama in this area.

The Inter-American Court also indicates, in judgments issued to member states says that the presumption of innocence applies in all matters and not only in criminal matters, in that the presumption of innocence does not operate in the processes of extinction of domain, the assumption can be misleading because the doubt arises as to whether or not it is being imputed an illicit act.

According to what the domain laws propose, these processes are not made to judge people for crimes, and do not establish guilt, despite this indirectly if it does, if assets are taken from a person through this action, the citizen and society are told that the domain of those goods was extinguished by the illicit acquisition or destination which affects the human being and generates social stigma to that person”,” states the report of the previous subcommittee.

Deputy Cano explained that the subcommittee agrees on the issue of fundamental guarantees, “it is an issue that as members of the Assembly we have to harmonize the project with what is established in the National Constitution.”

For his part, Deputy Leandro Ávila said that the project does not have legal congruence and does not define what will happen with institutions such as the Accounts Prosecutor’s Office.

We have proposed a technical table, a proposal for modification must be defined that allows what is desired a document of extinction of domain is a Panamanian-style law, not a document copied from other nations,” Avila said.

The new subcommittee will be composed of deputies Víctor Castillo, Emelie García and Fátima Agrazal; they will have 10 days to submit their report.

The initiative presented by the Ministry of Security has 94 articles and seeks to create and develop a regulatory framework, designed as a legal institute against assets of illicit origin or destination.

Facade of the General Directorate of Revenue (DGI).

The General Directorate of Revenue (DGI) of the Ministry of Economy and Finance (MEF), reported that they have initiated an update campaign on the registration of taxpayers.

Publio De Gracia, general director of the DGI, said that these are given with a view to improving as an institution because some processes such as locating taxpayers to remind them that they have a tax refund has become almost impossible to carry out.

De Gracia indicated that they are currently working to strengthen the tax culture in the country for the benefit of all people and that taxpayers have the obligation to keep their unique record up to date, due to the lack of updating of data of 75%.

Finally, De Gracia said that his administration wants to leave a legacy to make the payment of taxes easier, it is for this reason that the institution coordinates with the Public Registry, the National Land Authority (Anati), the Micro, Small and Medium Enterprise Authority (Ampyme) and that they communicate more easily, together with the Ministry of Trade and Industries (Mici).

Currently, the institution maintains various incentives for those taxpayers who pay their tax obligations on time, such as prompt payment, and in the case of property tax applies a discount of 15%.

The taxpayers of the entity can carry out up to 180 procedures online. Similarly, the institution is working on updating the Etax2 system to make it more user-friendly.

Tax evasion investigation

On the other hand, the institution is investigating some 127 cases of possible tax evasion, for an amount of approximately 177 thousand 2 million.

These cases are for the evasion of income and property tax (ITBMS). The audits began with complaints and internal investigations of the entity, where according to the institution so far there is only one of these cases of possible tax evasion exceeds 22 million.

GOVERNMENT CONSIDERS EXTENDING FUEL SUBSIDY

Organized groups demanded that the government implement measures in the face of the high cost of living, and among those agreed is the fuel subsidy.

The National Government is considering extending the fuel subsidy. The Minister of Commerce and Industries, Federico Alfaro, said Thursday that it is an issue that is under discussion but that “a decision has not yet been made.”

“So far I can only say that we are evaluating the possibility of extending that subsidy, which definitely helps Panamanians in terms of the high cost of living,” Alfaro said.

As part of an agreement reached after the struggle of various social groups, the Government froze, from July 18 and for three months extendable, the price of a gallon of gasoline of 95, 91 octane and diesel in B / .3.25.

The measure expires on October 18.

GREEN ALERT DECREED AT THE NATIONAL LEVEL FOR CYCLONIC EVENT IN THE CARIBBEAN

Rain, extraordinary tides above 16 feet, and temperatures of 29 to 30 degrees Celsius are expected in the Caribbean this weekend.

The National Civil Protection System (Sinaproc) decreed a preventive green alert throughout the Republic of Panama, due to the climatic conditions that are being generated by a cyclonic event in the Caribbean, which is generating indirect effects in Central America.

In addition, for this weekend rains and high tides are expected, above 16 feet.

The director of Hydrometeorology of Etesa, Luz Calzadilla, explained that tropical wave #36 intensified to tropical depression or disturbance #13. This means that there is a chance that it will become a cyclone. “We have to clarify, that at this moment the forecast of the National Hurricane Center has the category of disturbance, and already gave it the number 13 of tropical disturbance, in the passage in front of our territory, through the Caribbean, it can evolve,” he said.

He indicated that this disturbance is moving at an approximate speed of 37 km / h, and is currently on the coasts of Venezuela moving towards Colombia.

Sinaproc and Etesa will maintain 24-hour surveillance, and in case the amounts of precipitation are above schedule, they will proceed to declare a yellow alert. “There are still 48 hours of displacement, and when it enters the Caribbean basin it can strengthen very quickly,” Calzadilla said.

Sinaproc recommends to the Panamanian population:

  • Stay calm
  • People who live near areas vulnerable to flooding and landslides, being aware of flooding rivers and streams
  • Those who live near maritime areas, should be aware of waves.
  • While the alert lasts, you should avoid visiting beaches, rivers and spas.
  • Maintain a family emergency plan, with evacuation exit to safe places.

DRAFT LAW CREATING WOMEN’S MINISTRY MOVES TO THIRD DEBATE

Plenary of the Assembly debates the Ministry of Women.

With 36 votes in favor, Bill 811, which creates the Ministry of Women, was approved in the second debate in the Plenary of the National Assembly.

The vice president of the Assembly, Kayra Harding, clarified that the project is a commitment of the president and does not represent “creating more bureaucracy or increasing the state payroll.”

It should be recalled that the initiative of the Executive Branch seeks to reduce gender gaps and achieve human rights, equality, equity and justice for women in Panama.

In the opinion of Deputy Corina Cano, Bill 811 will encourage women to exercise positions of hierarchy in public service, politics and business.

For her part, Nellys Herrera, director in charge of the Women’s Institute, who, if the prerogative is approved, the same budget of the entity now in her charge, would pass to the Ministry of Women.

Meanwhile, Elia de Tulipano, member of the National Forum of Women of Political Parties and Gloria Young, of the Parliamentary Association of the Republic of Panama, referred to the need to create the Ministry of Women, since it is an advance in human rights and most of the countries of the American continent have it.

GOVERNMENT AND ALLIANCES MEET AT THE UTP TO START THE TRANSITION TO PHASE II OF THE DIALOGUE, BUSINESSMEN DO NOT ATTEND

Members of the National Government, social alliances and the Catholic Church, as mediator, are gathered in the UTP.

As part of what was agreed in the Single Dialogue Table, established in Penonomé, the National Government and the United People for Life Alliances, the National Alliance for the Rights of the Organized People (Anadepo), the Bastion of the Struggle of the East Chiricano, Ngábe-Bugle Region and peasants, met this Thursday at the Technological University of Panama (UTP) to begin the transition process and start the second phase of the dialogue.

“The Catholic Church, in its commitment to carry out the transition, held meetings of rapprochement with the business sector, the government and the alliances, to probe their positions before the beginning of the solidarity phase,” the Archdiocese of Panama said in a statement.

The representative of the Catholic Church, Maribel Jaén reiterated, from the facilities of the Technological University of Panama, that it is complying with what was previously agreed at the dialogue table that was established in the first phase in Penonomé, province of Coclé.

The church report pointed out that the businessmen, before sitting at the Dialogue Table, conditioned a series of rules such as postponing the dates of October 6 and 7 for the start of the dialogue, having symmetry in participation, and others. While the Alliances have reiterated that the agreements will be maintained, with the 8 main issues to be addressed, with their alternates in each sector, so they reject the request of the private company.

It should be remembered that in a meeting held this Wednesday, October 5, the Alliances and the Executive Body reaffirmed their willingness to comply with what was agreed, and since this Thursday, October 6, at 10:00 a.m., they have met to coordinate the methodology of the dialogue and choose a facilitator.

At the beginning of the meeting, Jorge Guzmán, of alianza Pueblo Unido por la Vida, questioned the breach of agreements to start this transition phase, such as the absence of SERTV for national transmission and reminded the Government that it is not a judge or party, but that everyone decides at the table.

300 HECTARES RECOVERED FOR THE STATE IN CHIRIQUÍ, A HIDDEN ASSET SINCE 1914

300 hectares located in El Pianista, district of Boquete, were restored as heritage of the Panamanian State.

Some 300 hectares located in the sector known as El Pianista in the district of Boquete, province of Chiriquí was restored as heritage of the Panamanian State.

After that, through an anonymous complaint to the Ministry of Economy and Finance in 2010, the acquisition of the territory more than a century ago was announced, by individuals, in clear contravention of Law No. 20 of January 31, 1913, on vacant and pardoned lands, and to the detriment of the State.

The Public Prosecutor’s Office of Panama, emphasizes that the Superior Prosecutor’s Office Specialized in Civil, Agrarian and Family Affairs, managed to declare the existence of a hidden property in this case.

Through the civil process of recovery of State land, the irregularities that occurred since 1914, the date on which farms were born as private property, were revealed, without following the procedure provided for in the law.

Therefore, in an appeal hearing, the First Superior Court of the First Judicial District of Panama, ruled that the sentence be annulled in the first instance.

The senior prosecutor, Juan Ruíz testified that the 300 hectares were acquired more than a century ago by individuals, in breach of the established rule of Law no. 20 of January 31, 1913, which emphasizes abandoned territories.

Article 80 of the Tax Code states:

“They are hidden goods of the State, not only those simply abandoned or hidden in their material sense, but also those in respect of which their primitive character of national property has become obscured.”

Because of defending the interests of the State or the municipality, Resolution No. 31 of December 7, 2020, creates  the Superior Prosecutor’s Office Specialized in Civil, Agrarian and Family Matters.

The legal concept that is regulated in article 80 of the Tax Code is used when the character of the national property has become obscure, and the assets denounced are in the hands of individuals.

FIRST ROBOTIC SURGERY OF THE PUBLIC SECTOR WILL BE CARRIED OUT ON OCTOBER 19 IN THE CITY OF HEALTH

Hugo RAS, a team that will allow the development of robotic surgeries, arrives at the City of Health.

This October 19, the first robotic surgery will be performed in the operating rooms of the Cardiovascular and Thoracic Institute of the City of Health.

With this procedure, Panama is positioned as the first country in Latin America to perform robotic surgery in the public sector, according to Alex González, director of Medical Benefits of the Social Security Fund (CSS).

Miguel Ángel Cáceres, coordinator of the Robotic Surgery program, explained that the surgery will be carried out with Hugo RAS, a robot that allows the opening of a patient, which is regularly 35 to 40 centimeters, with this technology to be between 8 to 11 millimeters.

In addition, the patient’s recovery, which regularly takes between 30 and 60 days, takes between 7 and 15 days.

According to the CSS, the City of Health will have five surgeons and specialists trained to carry out the surgery with Hugo RAS.

Currently this hospital center has the supplies for the first 120 surgeries.

The staff will be in the two operating rooms, including nurses, a biomedical team from the robotic equipment contractor, surgeons with their assistants, anesthesiologists, instrumentalists, circulators and assistants in case of more complex surgeries.

The first surgery to be performed with Hugo RAS in the City of Health is scheduled for the fourth week of October

Hugo RAS will allow oncological, urology and gynecology interventions. In addition, it is designed for more precise, fine, delicate and minimally invasive general surgeries.

Robotic equipment is characterized by being accurate, which allows specialists to enter spaces where manual skill does not reach.

Pediatric surgeries

In addition to robotic surgery, the first cardiac surgery on children will also be performed in the City of Health this month.

“We will no longer have to send so many children to operate outside because they will have the tools and equipment,” said Dr. González.

According to the doctor, the main and most complex services carried out by the Hospital Complex and the Hospital of Pediatric Specialties, will be transferred to the City of Health.

Advances of the City of Health

Previously, the CSS indicated that this October several of the infrastructures that make up the City of Health will be delivered. The work has an 86% progress.

It is expected that before October 15 the third phase will be inaugurated, which includes the administration building, the outpatient room with 220 offices and a ground floor that has several commercial premises.

The Atrium, the teaching area, the cafeteria and the Critical Adults building will also be inaugurated, which includes a space for the care of patients with Strokes, area for burn patients, operating rooms and 9 intensive care rooms.

The complete delivery of the largest hospital center in the country is expected to be on December 16, 2023, after more than 8 years of construction.

THIS WEEK’S RESTAURANT REVIEWS

LAZOTEA Restaurant and Rooftop for Brunch

Between trips, vacation and dieting, I’ve not been out to many restaurants lately.  But last Sunday morning, our Queen needed to feel extra special and asked her humble servants to accompany her to brunch.  Always on the lookout for something that we’ve never done before, we reached beyond the normal hotel brunch specials, looking for something unique and we definitely found that with LAZOTEA Restaurant and Rooftop.

Located on the edge of Casco Viejo, or the “beginning” of it depending on where you’re coming from, it’s right at the entrance to Casco just as you get off of the Cinta Costera.  (Golden Frog used to be next door.). Aaaaaanywho, we self-parked and paid the local 92-year old “watchiman” to care diligently for our vehicle at a mere $5.00.  I should add that they do have VIP parking, even on Sundays, but no-one other than us are allowed to touch the Queen’s car… … NO ONE.

Their brunch menu is very nice.  The prices are a little high, but the service is impeccable.  If you wanted the full brunch special, it’s actually only $35.00 and offers a selection of breads, a Fruit Parfait, Eggs Benedict (of several variations) and a Creme Brulée for desert.

The individual menu is available and as boys will be boys, they ordered pancakes which I was reluctant to allow them to have as it includes a portion of ice cream, Queen Sayira had the Lobster Tacos (holy yumminess!!) and I ordered a Fruit Parfait and Bacon Benedicts.  We could base this solely on my boys’ review – they both wanted more, but mean dad said “no”.  I mean, I’m still dieting and well, if I have to suffer, then they should too, am I right??

Not often do we get to feel like Royalty in Panama, but LAZOTEA did exactly that for us.

Final call?  We’ll be back.  But, I think I’ll just go with my queen, so we can indulge in the Open Mimosas or Open Aperol Spritz for just $20.00.  We wouldn’t want our kids to watch us as we acted silly and stupid… … just the perfect strangers who treat us like royalty.  Has!

This is a list of the number of cases per day since the first case was discovered in Panama

END NOTES:

Recently, my beautiful niece and her husband Kaz brought baby “Finny” into our lives and I couldnt be a prouder uncle given all they’ve had to endure over the last few years.  Also, good friends Jonas and Rodela were also blessed with the arrival of delightful Mika.

Being that both couples are new to this, I just want to wish all of you a lot of luck, cuz yer gonna need it!  Hahaha. Here are a couple of wonderful photos that they’ve promoted online.

Of course, all of us who’ve been parents know that this doesnt happen in one take.  Oh no, these little buggers rarely seem to cooperate.  But even when they don’t, the photo ops are a thing of beauty.  Here are a few we found online that should brighten your day just as it did mine:
