There sure is a lot of stuff going on in Panama relating to business and decisions that owners are going to have to make right quick!

As stated in Resolution 672 that came out today, Friday, July 24, 2020, “Cocle, Herrera and Los Santos have behaved well enough that they’re being given a cookie and the opportunity to open up a tad.” (Their words not mine.) As of July 27, MONDAY!, they all get to open “Car Sales in General”, “Private Sector Construction (with MINSA approval)” and “Professional and Administrative Services”. I mean, that’s nice and all, but I was kinda hoping for something a little more recreational, more lively, fun, and then I read a bit further which continues in the Second Article:

“To appease the wishes of Brett Mikkelson and his need for fine cuisine in his second home of Panama, we hereby authorize the opening of Restaurants and Fondas in the province of Los Santos”

That might have been verbatim and that might have just been selective reading with a splash of day dreaming. Either way, what this means to me, after crunching the numbers and doing long division, is that SMILEY’S in PEDASI is going to be opening soon!!!

In an interview with John Brock, proud owner of said fantastic establishment, he told me in that smooth manly southern drawl, in the manner of a quasi-Sam Elliott, “Well, ya’ll know that ah luv mah barbeque and if you got a hankerin for it like ah do, you best git yerself down here rahtnow!”

John is researching proper safety measures to open as soon as humanly possible. He hopes to be open by Tuesday, but without a doubt WILL be opening as soon as he gets his hands on 3,000 gallons of alcohol gel, 4 truckloads of Disinfecting Wipes, 1 container of K95 masks, 5 whole cows, and 300 cases of Belgian beer that he damn well better buy from me after all of this free publicity I just threw up on my website. Hahaha. No pressure John… no pressure.

There’s a Proyecto de Ley (Law Project) in the works in Panama that would extend “Fuero Laboral” to all employees, public and private, who get sick with COVID-19. “Fuero Laboral” translates to “Labor Law”, and is a mechanism that seeks to protect the worker’s right to not be fired for causes that, according to the Law, generates stability within the employment relationship. Usually, we see this more often during the course of a female employee’s pregnancy, birth of the child and until the child turns 1 year old. She would be protected from being fired, unless she reaches a mutual agreement with the company for whatever reason. The new Proyecto de Ley, would give any employee who contracts the virus, the right to fuero laboral for a year from the date they get sick. I am all for employee protections and rights. There’s a problem with this law however and it all goes back to basic math.

When the virus hit Panama, the government opened a chance for companies to suspend the contracts of their employees primarily because the government forced everyone to close shop. It’s hard to pay employees if you can’t conduct business. The government’s plan was to give food and money to the people in the place of their salaries. (That hasn’t worked very well so far.) This suspension is stipulated in Law 81. There were other laws that came out, such as the Law 71 that allows for a reduction of hours for those companies who were authorized to remain open and the Law 95 which extends the suspended contracts until the end of the year.

MINSA has given instructions to these companies who were told to close, stating that they were not going to be able to have more than 20% of the normal capacity in their businesses to avoid a concentration of people in enclosed spaces.  It makes sense.  This way, it helps to reduce the chances of someone innocently coming to work already carrying the virus.

Now for the math:

If you have 100 employees, only 20 can go back to work whenever your business is authorized to reopen.  However, if you have 50% of your employee sick, you’re forced to maintain 30 people on the payroll that you can’t release legally.  Also, if you have everyone on suspended contracts, if they get sick, are they included into those who can take advantage of the fuero laboral?  They didn’t get sick on the job, but they’re legally still employed.  Remember that the rules of the suspended contract means that once the government gives the go, ALL of your employees have to come back to work with the same original salary.  But, if you’re not able to operate at the same level, or are not allowed to due to MINSA… I think you get the point.  Eventually, 70% will have been infected.  I’m worried that this may be the Panamanian government’s plan to push all responsibility of care on the businesses after having crushed the economy.

Get ready for a rash of businesses rushing to come to some agreement to release 100s or 1,000s of employees in the next couple of weeks prior to this becoming law.

The network of Centers for Disease Control and Prevention (CDC) has changed some of its recommendations to isolate itself in case of having coronavirus now that there is more knowledge about the risk of contagion of the disease COVID-19 .

CDC now advises most people with active cases to isolate themselves for 10 days after symptoms begin and 24 hours after the fever is gone. For those who test positive for coronavirus but are asymptomatic, the health agency recommends 10 days of isolation from Friday, starting on the day of the test.

The current recommendation until the change was that people remain isolated until they have two negative coronavirus results. However, this measure proved impractical due to a paucity of evidence, according to The Washington Post.

During the six months that the coronavirus has been in the United States, several studies have suggested that most infected people can spread the virus for a short period of time, typically four to nine days. A long-range study that tracked high-risk contacts in hospitals and homes found that exposure to the virus occurred within five days after the patient fell ill.

Isolation starts counting after the day the test was performed.

According to the CDC, a “limited number of seriously ill people” can continue to produce the virus longer, which could justify the isolation being extended to 20 days in the mentioned exceptions.

Isolation recommendations are used for people who have tested positive, while the term quarantine is intended for those who have been in contact with an infected person but have not confirmed that they have been infected. For these latter cases, CDC continues to recommend a 14-day quarantine period.


PUBLISHING A RESOLUTION AUTHORIZING THE REACTIVATION OF SOME ACTIVITIES IN LOS SANTOS, HERRERA AND COCLÉ

Through Resolution No. 672 of July 24, 2020, the Ministry of Health (Minsa) of Panama authorized the reactivation, operation and mobilization of some commercial, industrial and service activities in the provinces of Los Santos, Herrera and Coclé from July 27.

The activities contained in block 3 of economic activities that will be reactivated are car sales, construction of the private sector with the approval of the Ministry of Health (Minsa), and professional and administrative services.

The reactivation of restaurants and inns in the province of Los Santos, contained in block 4 of activities, was also authorized.

According to the document, these activities must comply with the following parameters:

  • They will be able to operate during their regular work schedule, except for the days decreed as total quarantine.
  • The guidelines for the return to normality of companies issued by Resolution No. 405 of May 11, 2020 and the sanitary guidelines for post-COVID-19 operations should be followed.
  • Biosecurity implements such as alcohol gel, masks, gloves will be provided to workers.

The Minsa decided to reactivate these activities in these provinces due to the low incidence of COVID-19 cases that have been registered in recent weeks.

THE DEADLIEST HOT SPOTS IN THE WORLD CAN BE FOUND THROUGHOUT LATIN AMERICA

Latin America now represents 7 of the world’s 10 deadliest Covid-19 hotspots, and in many countries, data suggests that the situation will only worsen.

Chile reported 80 deaths per 1 million people in the past seven days, and Peru added 154 deaths per million to its account, more than anywhere else in the world. “The surprising thing is that the evidence is low, and despite the low evidence, the numbers are ugly,” said Alberto Ramos, chief economist for Latin America at Goldman Sachs Group Inc. in New York. “Can you imagine what that would be like with the average tests?”

PLASMATÓN 20-30 SEEKS TO RAISE A DONOR DATABASE

Active Club 20-30 organizes the Plasmatón.

Giacomo Tamburrelli, from the Active Club 20-30 of Panama, explained that the launch of “Plasmatón 20-30” will seek to create a database with convalescent plasma donors in the fight against COVID-19.

This database will help authorities find those volunteer donors who have overcome COVID-19 disease and lend their plasma so that other patients can recover.

PANAMA FORMALIZES INTEREST IN THE COVAX MECHANISM

Panama formalized its interest to adhere to the global Covaxmechanism and thus access vaccines against Covid-19.

This is a joint fund that will represent the interests of the member states of the World Health Organization (WHO), seeking to negotiate the best prices with the producers of future vaccines against the virus and access to sufficient doses.

HOSPITAL PAITILLA OPTS FOR TREATMENT WITH PLASMA

Hospital Paitilla joined the group of clinical centers that are using convalescent plasma therapy as part of the treatment against Covid-19, with the prior consent of the patient or their relatives.

This therapy consists of transfusing plasma from the blood of those who have already gone through the disease to patients who carry the virus.

The director of the Blood Bank of the Paitilla Hospital, Benito Castillo, stressed that, after two weeks of preparation, they started this therapy on July 4, when they received the first plasma donor. To date, they already have 21 donors.

He explained that the donations allowed the transfusion of about 19 patients, most of whom recovered satisfactorily.

Castillo indicated that the donors must be Covid-19 patients with approximately 15 days of having recovered and that their clinical symptoms have not been among the most severe.

At the Paitilla Hospital Blood Bank they have received 21 donors, whose plasma helped improve the health condition of 19 people affected by the new coronavirus. Other hospitals, such as Santo Tomás, plan to apply this type of treatment in the fight against the virus in the coming weeks.

“The patients who developed mild symptoms of the disease are those who are presumed to have better immunity against the SARS-CoV-2 virus,” explained the doctor, who added that pregnant women are not candidates to donate plasma.

For the specialist, the experience of the use of convalescent plasma in the Paitilla Hospital “has been quite good”, according to reports from the doctors treating patients of Covid-19.

The director of the National Civil Protection System (Sinaproc), Carlos Rumbo reported that 64 houses affected by floods have been registered in the West sector in Vista Alegre, Vacamonte, Veracruz, Playa Leona, Cerro Silvestre and Bique.

ENTREPRENEURSHIP SOCIETIES, THE PROPOSAL THAT SEEKS TO INCREASE NEW TYPES OF BUSINESS IN PANAMA

The bill on entrepreneurship approved in the third debate in the National Assembly (AN), seeks to equip small merchants with the necessary tools so that they can start their operations, explained its proponent, independent deputy Raúl Fernández.

The proposal on “entrepreneurial societies falls flat on the finger” says Fernández, because the pandemic is going to generate an employment deficit of over 20% and Panamanians will have no alternative but to use talents to do business, be your own bosses and achieve goals based on entrepreneurship.

In this sense, the parliamentarian explains that, the entrepreneur at least needs a solid basis to know what could arise and for this reason the initiative was proposed that proposes the creation of a new legal entity, which will be prepared at “very low cost, in a digital, without paying a single rate, with tax incentives and without the need for a resident agent ”.

This would give the entrepreneur the opportunity to formalize to be able to access a much larger clientele. Fernández pointed out that the proposal grants tax benefits for the first two years and that it can be reinstated for two more years, which is the time it takes for an undertaking to emerge.

Today was International Private Investigator’s Day. Yay me– we totally celebrated today in full uniform in our home-office by writing reports and conducting Zoom Meetings.  

Established July 24, in honor of who we consider to be the first Private Investigator in history, Eugene Francois Vidocq, a French ex-criminal, founded one of the first private detective agencies, called “Le bureau des renseignments”(Office of Intelligence). Here, he oversaw the work of other detectives, many of whom were ex-criminals such as himself. He is credited with having introduced record-keeping, criminology, and ballistics to criminal investigation. He also created indelible ink and unalterable bond paper with his printing company. Apparently, he had an altruistic bent as he claimed he never informed on anyone who had stolen for real need. With Vidocq, the concept of the private investigator as we know it today, was born.

Interestingly enough, today we also celebrate the International Day of Tequila.  Coincidence?  I think not!!!
