Doing business in Panama is seemingly impossible to do for some people.  As an investigator, I see so many people get defrauded and almost every time it’s because of how the investor managed their investment.  Case in point, we have a client who heard of a great investment from a friend into a Real Estate deal in the country of Panama.  Wanting to get in on the action, they contacted the developer and after a few minutes on the phone, they transferred $500,000 to their Panamanian bank account.  Yes, FIIIIIVE HUUUUUUNDREEEEED THOOOUUUUUSAAAAAND DOOOOOLLAAAAAARS….  Now, after 6 years of no development or returns, they’re trying to get their money back.  A quick investigation shows that the recipient of said ridiculous amount of money purchased a really nice car, brand new, CASH, in 2018, and then another in 2019 and then another at the end of 2021.  He also moved from a shitty little house in a bad neighborhood, to a nice residential building in Punta Pacifica.  The difference in rent was $250 per month vs $3,000 per month.  The account that received the funds was depleted within 3 years down to $60,000 and then at the beginning of 2023, when the defrauded customer started threatening him to “yell even louder”, the account was closed completely with the funds being transferred to another account at a different bank.

There are so many things wrong with this and the customer is the one to blame almost entirely.  Before investing in Panama, draw up a legal contract with a local law firm that has been tried and trusted in such matters.  The contact, to be legitimate, MUST be done in Spanish, otherwise it’s not a legitimate contract in Panama and any claims thereafter will not hold up in court.  Secondly, never send the full amount of an investment in advance.  Thirdly, but actually most importantly, you need to conduct some Due Diligence on the person and project you’re looking to invest in.  In Panama, it costs less than $1,000 in most cases to hire someone to conduct a proper DDI or “Due Diligence investigation” on an individual or the project… … ah, but that’s too expensive… (insert palm slap to forehead here).  Sure, but now we’re probably going to charge $5,000 for the investigation, not to mention what they’ll be charged for the legal fees.

Another thing that burns my ass (not including last week’s chili that the Queen made with extra Aji Chombo) are when all of the signs show probable complications after we´ve conducted the DDI, but the client goes ahead and invests (and loses) anyways.  We conduct A LOT of Due Diligence cases and it’s usually a cut and dry scenario.  We check all open source databases, licenses, corporate registries, properties, credit history and references.  If the person has no sign of any negative background information in the open source research, their licenses are up to date, there were no bankruptcies, the credit history is standard and stable (at a minimum) and our developed HUMINT references come back with positive vibes, it’s usually safe to invest.  We just had one DDI, where the subject claimed to be from London, but lived 20 years in California.  They were “not required to have a license” in their field, and the company they managed was located in California.  When we did the research, we learned that they had JUST moved to California, but lived previously in Georgia and Maryland.  Their company was registered in Maryland and in Maryland a license is required for their activity.  Oh and they filed for bankruptcy 10 years ago and have an extensive criminal history in Georgia.  The client invested… in the immortal words of Jeff Foxworthy, “Here’s your sign…”  The good news is we’re certain to be hired for the recovery investigation sometime within the next 5 years.

But seriously, friends, Do Your Research.  Hire a proper lawyer.  Prepare the legal documents.  Do NOT forward the total investment.  Do not invest if you find ANYTHING wrong on the person or the company.  It’s really not worth the headaches.  There are too many great opportunities in Panama, to waste your time and money on the first thing that comes along.

PANAMA HAS MORE THAN 187,000 HECTARES OF RESTORED FORESTS

Panama celebrates International Day of Forests.

Panama has 187,657.08 hectares of restored forest, a key achievement to continue promoting an economic development strategy, according to a recent report by the Ministry of Environment (Mi Ambiente).

This refers to about 8,452.38 hectares of restored surface in the period 2021-2022, with a recovery of undergrowth and secondary forests through assisted natural regeneration in approximately 179,204.7 hectares since 2019.

During this period, silvo-pastoral systems, forest plantations, and agroforestry were implemented, monitored by the Forest Restoration System (SMR). These strategies aim to guide the country towards achieving the long-term national goal of carbon neutrality by 2050.

The National Forest Restoration Program has as its main objective to increase forest cover through the restoration of 51,000 hectares in the period 2021-2025, a purpose established in Executive Decree No. 137 of May 21, 2021.

The PNRF has had a clear vision since its inception regarding the management, protection, and conservation of priority watersheds that produce water at the national level. Its implementation has been crucial in reducing deforestation by 26.4%, as stated by the Ministry of Environment.

For the period 2000-2012, deforestation was 11,415 hectares per year, while for the period 2012-2021, deforestation had been reduced to 3,013,000 hectares per year. If we compare both periods, this represents a significant reduction in deforestation of 26% (as compared to the previous year).

Another key factor in the reduction of deforestation is the issuance of Resolution No. 0201, which was updated for the fourth consecutive year on November 24th, 2022, to temporarily suspend for one year the granting of special permits for subsistence forest use and its modalities, as well as community permits and concessions in tropical forests for a term not exceeding one year.

Victor Cadavid, National Director of Forestry at the Ministry of Environment, highlighted that the beginnings of the PNRF were difficult due to the arrival of the pandemic in the country. Sensitization efforts were carried out on the importance of forests at the national level, with the slogan ‘It’s not the quantity, but the quality, every tree counts’.

In addition to the National Forest Restoration Program, since 2019 the National Government has implemented actions to guarantee the protection, conservation, and increase of forest cover, which includes strengthening forest monitoring systems such as the Forest Traceability and Control System (STCF) and the Restoration Monitoring System (SMR).

Likewise, sensitization efforts on forest conservation, protection, recovery, and restoration, as well as the establishment of the Environmental Crimes Investigation Office, which has the support of the Specialized Superior Prosecutor’s Office in Environmental Crimes, attached to the Office of the Attorney General of the Nation, to prevent and control illegal logging.

According to data from the Ministry of Environment, the provinces of Bocas del Toro, Chiriqui, Cocle, the Ngöbe Bugle comarca, Darien, Herrera, Los Santos, Veraguas, and Panama have shown recovery of their forest cover, while Cocle and Colon, the Embera Wounaan comarca, Guna Yala, and Panama Oeste showed a decrease.

With this challenge, Panama celebrated International Day of Forests on March 21st, this year with the slogan ‘Forests and health’.

THE THIRTEENTH MONTH PAYMENT COULD INCREASE FOR THE PUBLIC SECTOR

The Thirteenth Month could increase for the public sector.

Since March 2022, Draft Law 246 of Project 817 has been under discussion, which seeks to modify Law 133 of 2013 regarding the Thirteenth Month payment for public servants, before the National Assembly. The initiative was proposed by the deputy of circuit 8-5, Tito Rodríguez.

Presented to the Committee on Labor, Health and Social Development, it is focused on increasing the current amount of 170.00 balboas by 80.00, totaling an increase of 250.00 for three equal installments per year, if sanctioned by President Laurentino Cortizo.

The discussion in first debate started this week by the plenary, as reported by Rodríguez on the Instagram social network.

The objective of the proposal is to increase the payment of the Thirteenth Month to public servants of the State, to boost and level their economic situation as a result of the Covid-19 pandemic.

It was in the year 1974 that Law 52 authorized public entities to pay this special bonus, which is calculated based on the monthly salary.

The payment of the thirteenth month is made every fifteen days in April, August and finally in December, for the country’s work sectors. However, the first disbursement of the year is advanced to March for public servants.

DRIVER OF BUS THAT CAUSED PASSENGER’S DEATH REACHES PLEA AGREEMENT

He is sentenced to 8 years in prison. The passenger who died received a blow after reporting an illegal increase in the fare.

A sentence of eight years in prison was finally imposed, following a plea agreement, on the driver of the Burunga – Panama route, Francisco Vega, 27, for fatally beating passenger Domingo Rodriguez, a 52-year-old chef who refused to pay an illegal fare increase. The verdict was received with disappointment and sadness by the victim’s family lawyer, Suky Yard.

Yard said she recognizes the figure of the plea agreement as a quick solution to conflicts, but explained that in that negotiation only the aggressor’s lawyer and the Public Ministry intervene, but not the representation of the victim’s family and eight years of sentence does not seem fair to her, when it is a case in which the victim spent three months fighting for his life and according to his medical history,  died as a result of multiple fractures in his head from the beating received.

She recalled that Rodriguez was attacked last May at the Albrook Transport Terminal by Vega, for defending his right to avoid abuse when he claimed the established fare set by the authorities, and hoped that the case would set a exemplary precedent.

The sentence also includes as an additional penalty the inability of the convicted person to drive public transportation for four years after serving the principal sentence.

HORMONAL CONTRACEPTIVES PRODUCE A SLIGHT RISK OF BREAST CANCER

Hormonal contraceptives produce a slight risk of breast cancer.

All hormonal contraceptives carry a slightly increased risk of breast cancer, including those that contain only progestin, which are increasingly used, according to a study published on Tuesday.

The researchers who conducted the study emphasized that the increased risk of breast cancer should be balanced against the benefits of hormonal contraceptives, including the protection they provide against other forms of female cancer.

The increased risk of breast cancer was already well known for contraceptive methods that combine progestin and estrogen.

But although the use of contraceptives containing only progestin has been increasing for more than a decade, until now few studies focused on their specific effect on the risk of breast cancer.

The new study, published in the journal PLOS Medicine, found that the risk of a woman developing breast cancer was approximately the same for hormonal contraceptives that had both estrogen and progestogen as for those that only had progestogen.

According to this research, women who use hormonal contraceptives have a slightly increased risk of developing breast cancer, around 20% to 30%, regardless of the method used (pill, IUD, implant, or injection) or the formula used (estrogen-progestin or progestin-only).

Taking into account that the probability of breast cancer increases with age, the authors of the study calculated how much excess absolute risk is associated with hormonal contraceptives.

For women who took hormonal contraceptives for a five-year period between the ages of 16 and 20, it represented eight cases of breast cancer per 100,000. Between 35 and 39 years, it was 265 cases per 100,000, they said.

It is a transitory risk

“Nobody wants to hear that something they are taking will increase their risk of breast cancer,” said Gillian Reeves, professor at the University of Oxford and co-author of the study. “What we’re talking about here is a very small increase in absolute risk.”.

And she added: “These increases in the risk of breast cancer, of course, must be seen in the context of what we know about the many benefits of taking hormonal contraceptives”.

“Not only in terms of birth control, but also because we know that oral contraceptives actually provide substantial and long-term protection against other female cancers, such as ovarian cancer and endometrial cancer,” she said.

Progestin-only contraceptives are recommended for women who are breastfeeding, may be at risk of cardiovascular problems, or are smokers over 35 years of age.

WHEN WILL THE NEW ONCOLOGY CENTER BE BUILT?

Around 3,000 new cancer patients are admitted each year.

The Minister of Health, Luis Francisco Sucre, stated today, March 22, in the Budget Committee of the National Assembly that they “really” do not have a date for the construction of the new National Oncology Institute (ION).

Sucre announced that the President of the Republic gave instructions to address the issue, so on Monday, March 27th, he will meet with the Minister of Economy and Finance to discuss the financial feasibility of this project.

After several setbacks, the Ministry of Health (Minsa) decided to cancel in January of this year the tender for the construction of the new ION, which amounted to $434.8 million.

In a resolution dated January 11 of this year, the Ministry of Health stated that it is necessary to make modifications to the scope and specifications of the work, related to the land and new location of the hospital. This entails the preparation of a new set of bidding conditions and the cancellation of the public act that had already been convened.

The current structures of the ION, located next to the Ancón Hill, are at maximum patient capacity. Overcrowding is evident from the moment you reach the main entrance: the hallways have become waiting rooms and there are small consult rooms in tight spaces.

It is also necessary to have a larger area for medical equipment, and the chemotherapy room has little capacity to attend to the large number of patients who come for consultation daily.

The scenario described is the reality for cancer patients and their accompanying family members who come to receive treatment in these facilities, which until 1999 functioned as the old Gorgas Hospital. However, this has been the situation for several years, as Oncology authorities first raised the need for a new structure in 2007.

The records on the website of the National Oncology Institute (ION, for its acronym in Spanish) show that around 3,000 new cancer patients are admitted each year.

Available data from 2020 indicate that 3,586 cancer patients were admitted for the first time to consultations, of which 2,546 were insured and 1,040 were uninsured.

In response to the situation, the President inaugurated on October 12, 2022, the regional oncology unit of Azuero, in the new facilities of the Anita Moreno regional hospital, in La Villa de Los Santos, which required an investment of $249,667.

DISCOUNT FOR RETIREES AND PENSIONERS IN PUBLIC TRANSPORT

Discount for retirees and pensioners on public transportation.

In intercity buses, trains, boats, and ships, a 30% discount must be offered to retirees, pensioners, and senior citizens, as established by Law 6 of 1987. Likewise, airfares from national and foreign public or private companies must deduct 25% from the cost for this group of people.

The Consumer Protection and Competition Defense Authority (ACODECO) is the institution responsible for monitoring compliance with at least 20 discounts and benefits that retired citizens, pensioners, and senior citizens are entitled to, provided that women are 55 years or older and men are 60 years or older.

Special window for retirees is a right

Therefore, state and private companies that provide public services must have a special place or window for the attention of these people, and ACODECO recommends extending preferential treatment to other businesses as a healthy practice.

The amount of the pension will be equal to 60% of the monthly base salary and 1.25% of the monthly base salary, for each additional 12 credited contributions to the required number of contributions.

THE PERSON IMPLICATED IN BEATING OF YOUNG MAN WHO DIED ON VIA ARGENTINA TO FACE CHARGES OF MURDER; THREE ARRESTED

Rafael Baloyes, Homicide and Femicide prosecutor.

The Homicide and Femicide prosecutor, Rafael Baloyes, said that he will press charges for intentional homicide against the three individuals apprehended Wednesday morning by the National Police for their alleged involvement in the death of Antonio Javiera Batista, which occurred on March 6 during a tumultuous brawl on Via Argentina.

Baloyes confirmed the apprehension of three individuals who allegedly inflicted blows on various parts of the victim’s body and could be directly related to his death.

During the investigation, the prosecutor’s office analyzed 16 videos obtained from security cameras of several businesses located in the area where the incident occurred, and in which the apprehended individuals are seen striking the victim.

Regarding a police officer who was present during the incident and whom some wanted to assign some responsibility for the events, he clarified that the officer was free and attempted to stop the brawl.

Baloyes explained that the investigation involved multiple procedures to establish the possible connection of the apprehended individuals to this case.

Under Law 70 for the Protection of Domestic Animals, actions that constitute animal abuse can be penalized. Article 1 states: This law aims to prevent, eradicate, and penalize mistreatment, abandonment, and acts of cruelty and/or torture against domestic animals.

For the purposes of this law, the following are evaluated:

Acts of cruelty: Inhumane actions that cause unnecessary pain and suffering to another living being.

Exploitation: Commercial use of an animal species.

Crowding: Piling and crowding animals in conditions that threaten their physical integrity and health.

Torture: The existence of a concrete purpose, in addition to intentionally inflicting severe suffering or pain, are some of the points evaluated for the purposes of this law

RESIDENTS OF BURUNGA AGREE TO NEW MEETINGS WITH IDAAN

At the meeting, protesters were asked that each sector appoint a chair of a water committee.

Residents of Burunga, and other sectors of the Arraiján district, held protests throughout Wednesday, and were able to meet with the director of the National Aqueducts and Sewers Institute (IDAAN), Juan Antonio Ducret.

After several hours of meeting at the Arraiján City Hall, the residents and the director of IDAAN agreed that a technical visit to the tanks of several sectors will be carried out next week in order to provide short-term solutions.

IDAAN Director Juan Antonio Ducret stated that they also agreed to have frequent meetings with organized communities.

During the meeting, the protesters were asked to appoint a president of a water committee for each sector to improve communication.

With the appointment of this person, meetings will be held with the participation of the communal boards, the Arraiján Municipality, IDAAN, and any other necessary authorities, said Juan Antonio Ducret

He stated that with the support of the Governorship of West Panama, through the technical board, support will be provided to IDAAN to seek solutions to close the gap and provide solutions to the population.

In La Chorrera they demand streets

On Tuesday, residents from three neighborhoods in the Playa Leona district of La Chorrera, Panama Oeste, closed two lanes of the Arraiján-La Chorrera highway for three hours, demanding road repairs.

Holding signs and sounding pots and pans, residents from Peña Blanca, La Mitra, and Alto Viejo blocked the road with barricades made from various materials. The protesters demanded the presence of a Ministry of Public Works (MOP) official capable of responding to their demands before reopening the road.

Eugenio Rivas, a resident of the Peña Blanca area, said they have been demanding road repairs from local authorities and the MOP for years, without their demands being addressed.

Gisela Vega, on the other hand, indicated that, due to the poor road conditions, drivers of internal routes and taxis have increased the cost of fares or refuse to transport them.

PANAMA ISSUES $1 BILLION GLOBAL BOND

THE MINISTRY OF ECONOMY AND FINANCE (MEF) announced this morning that the Republic of Panama, through the MEF, issued a Global Bond in the International Market for the sum of US$1 billion, with a coupon and yield of 6.853% due in 2054. The reopening of the Global Bond due in 2035 was also carried out for a total amount of US$800 million, with a coupon of 6.40% and yield of 6.161%.

According to the MEF, this operation is part of a financing strategy for the General State Budget of the 2023 fiscal year and, in turn, for the execution of liability management operations.

“The market’s reaction was positive, as offers for more than US$9.5 billion were received from more than 260 investors from North America, Europe, Asia, Latin America, and the Middle East. This demonstrates the foreign investors’ confidence in the country,” said the MEF.

MINSA ANNOUNCES THE END OF MANDATORY MASK USE IN PUBLIC TRANSPORT

In Panama, the mandatory use of face masks in public transportation has been in effect since June 2020.

Once published in the Official Gazette, the mandatory use of masks in public transportation and for food handlers will no longer be required, announced on Monday, March 20th, the Minister of Health, Luis Francisco Sucre.

“We are already in the legal procedures to make it official and upload it to the Official Gazette, to implement the lifting of the measure,” Sucre stated, according to a statement from the Ministry of Health (Minsa).

However, the Health Minister clarified that the use of masks will still be mandatory in health facilities. At the same time, he suggested that patients with chronic diseases continue to use it as a protective measure.

As of 4:00 p.m. on Monday, the measure had not yet been published in the Official Gazette.

At the beginning of June 2020, three months after the Covid-19 virus arrived in the country, the use of masks became mandatory nationwide, both in open and closed spaces.

ANOTHER INCREASE! PRICE OF MILK INCREASES IN PANAMA

The increase is reflected in the stores in Panama.

The deficit of 200 million liters in annual production in Panama, together with the increase in fuel prices, has led to an increase in the price of milk from 0.38 cents to 0.55 cents paid to the producer. This is reflected in the final price paid by consumers in stores, resulting in an increase of 0.17 cents.

According to the Minister of Agricultural Development, Augusto Valderrama, the importation of products such as milk, rice, and other basic necessities has caused producers to have less hope for national sales, which anticipated an increase in the price of milk and its derivatives.

“We are a deficit country and consume 400 million liters of milk per year, but only produce 200 million,” the Minister stated.

FUEL PRICES IN PANAMA TO CHANGE ON MARCH 24 TH

Fuel prices in Panama will change on March 24th.

The price of fuel could increase or decrease starting on Friday, March 24th. The announcement will be made by the National Energy Secretariat through a statement with a list of prices corresponding to the provinces and regions of the country.

At the beginning of March, the entity announced the new maximum sale prices of liquid fuel in Panama, which reflected a decrease and began to apply from Friday, March 10th until Friday, March 24th.

However, the general prices do not affect the subsidy that the National Government established through the extension of the subsidy to set the price of fuel at B/.3.25 per gallon or B/.0.859 per liter (95, 91 gasoline and diesel), which will remain in force until Tuesday, April 1st, 2023.

Until April 1st, 2023, the Cabinet Council of Panama approved the extension of the subsidy for 91 and 95 octane fuel, in addition to diesel, totaling around 44 more days than previously announced when it was known that the deadline would be Wednesday, February 15th..

THE FENTANYL CASE IS EMBEDDED IN LOSS; THERE ARE NO RESPONSIBLE PARTIES

The Public Ministry is investigating the disappearance of 19,000 doses of fentanyl.

It has been almost 15 days since the report on the alleged theft of 19 doses of the drug Fentanyl reached the Anti-Corruption Prosecutor’s Office, and so far no one responsible has been identified.

The Public Ministry is conducting four inspections at the Social Security Fund (CSS) in the general warehouse, the warehouse of the Dr. Arnulfo Arias Madrid hospital complex, the medical directorate, the pharmacy, and other offices.

These inspections aim to establish the logistics chain from the moment the drug arrives at the CSS.

The report on the loss arrived on March 6 at the Anti-Corruption Prosecutor’s Office. No one has been arrested, and at this moment, prosecutors are working on the reconstruction from the moment the fentanyl enters until it ends up in someone’s hands,” said the acting prosecutor, Javier Caraballo.

Caraballo confirmed that the Public Ministry is investigating the disappearance of 19,000 doses of fentanyl. He stated that the investigation is currently focused on the loss of the drug, and it will be the results of the investigations that could give a different perspective to this case.

The CSS opened an administrative process against a health area employee who is allegedly the owner of a briefcase with supplies and medicines, including Fentanyl, which was found in an improper area.

The administrative process is being carried out respecting due process and the employee’s rights, confirmed the national legal advisory directorate of the institution.

The CSS General Directorate added that a complaint was filed with the Office of the Attorney General last November for the theft of Fentanyl.

The CSS also ordered a medical audit whose results were provided to the Public Ministry.

As part of the administrative processes underway for this case, the CSS has also rotated personnel in the Pharmacy and Operating Room areas.

2023 STICKERS: PANAMA MUNICIPALITY EXPLAINS THE DELAY

Stickers 2023: Panama Municipality Explains Delay.

The Municipality of Panama, through the Treasury Department, reported that the delay in delivering stickers this year to vehicle owners registered in the district of Panama is due to a design change that incorporates the QR code to be implemented by the Land Transit and Transportation Authority (ATTT) for security reasons.

In a statement, the municipality explained that “As an intermediary institution in the process of delivering license plates and stickers, the Panama City Hall apologizes to taxpayers for the inconvenience and commits to making the date of receipt of the distinctive badges by the Chapala Vocational Center publicly known.”

It indicates that vehicle owners can confirm the availability of their stickers before going to Payment Centers at Parque Francisco Arias Paredes, Magna Corp in Campo Alegre, Crystal Plaza in Los Pueblos, or La Cabima in Las Cumbres, by accessing the link: Citas Application (tustributos.com).

Law 15 of 1995 establishes that the ATTT is responsible for issuing the Unique Registry of Motor Vehicles. Resolution No. 71 of February 9, 2022, determines the specifications of the annual stickers for this entity, while Law 71 of 2015 grants the Chapala Vocational Center the responsibility of issuing the vehicular document once it is approved.
